You're a victim of a crime if the crime is directed at you. She was a passer by. If you see someone torturing someone else and suffer psychologically it still doesn't mean you're the crime's victim since it wasn't directed at you. Was there a hostage situation? No. Rape, torture, human trafficking directed at her? No.

I'm the beneficiary.

U visas not very easy to obtain, one needs to have I918 (I think from DA or police)

or a letter, if everyone was ordered inside that means don't even peek out,if the

criminal was apprehended and convicted, there's no use for any statements from her

she would not qualify, even with the victim compensation a Drs statement would be

needed as to Y she miscarriage...check with an atty but I don't see her getting a U visa

As the link says...criminal activity in at least one of the following categories: rape, torture, trafficking, incest, domestic violence, sexual assault, abusive sexual contact, prostitution, sexual exploitation, female genital mutilation, hostage situations

I guess she can file on the basis of hostage situations. What do you think?

Do we any experiences related to U Visa on the forum from where i can learn what is needed & where to get that documentation in order to file?

Could somebody pls explain me the steps of this process like how much time it takes, when she can get EAD, fee, when she will be eligible to file green card etc

According to your initial post your cousin was never held "hostage". There was simply someone in the back yard of her house? I am very sorry for what happened to her but I have to disagree, I do not think she qualifies for U-Visa. But it doesn't hurt for her to contact the Prosecutor where she lives to offer up help in the court case. But it kind of sounds to me like she did not even see the guy as she was in her bedroom?

I have a cousin & she is living in USA for over 6 years (legally on H4).

So her Husband is running out of time, and the Employer has not sponsored them for a GC?
