If I am understanding it correctly, once you have filed for AOS and received the NOA1 from that -- not the final approval just the "acceptance/receipt" document -- your husband will be eligible for "Obamacare" in California -- see this .pdf from the Covered California site:

https://www.coveredca.com/PDFs/English/Covered_California_List_of_Lawfully_Present_Individuals.pdf

Which lists "Aliens whose visa petitions have been approved and who have a pending application for adjustment of status".

Please someone correct me if I'm wrong, but I believe my fiance (soon husband!) will also qualify for the ACA in California once we have filed the AOS papers. He has an approved K-1 and we are filing for AOS so we meet that requirement. At least I hope so, as that's what we're intending to do.

Relationship since April 2006

K-1 Visa: I-129F filed November 6, 2012, NOA2 May 17, 2013, Interview and Approval July 24, 2013

POE San Diego, September 13, 2013, Wedding October 25, 2013

AOS filed November 19, 2013, EAD/AP received January 30, 2014, interview and AOS Approval on February 27, 2014.

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

No RFE at any stage, thanks to VisaJourney!

Wow lots of confusion about ACA aka Obamacare. You have until March 1, 2014 to obtain qualifying insurance. If you are newly immigrated you have a three month grace period. If your state has a state exchange this is where you need to look. If you don't have a state exchange you must use the Healthcare.org site which is currently experiencing problems.

Allow me to correct myself, you don't have to buy off the exchange, you can buy anywhere as long as it is a qualifying plan. If your employer offers insurance meeting the requirements you should buy from them, if they don't then you should visit the exchanges......WHY? because of the discounts based upon your income.

I am not a health care navigator nor do I want to be one. I read thus I learn.
