Hey, I came to the states on a F-1 visa as well. My husband and I got married in June and we filed the AOS by the end of september. I recommend not going back to your country after married cause you may not be able to return. I was really dumb and went home for two weeks without husband and I almost didnt make it through the airport! SO just send you papers after you get married (I-130, I-485, I-693, I-864, I-765 and I-130) I know I know its a lot of forms! take your time! If your boyfriend/fiance is a USC you can send your papers as soon as you have them all ready, (no priority date to follow) After your submit your papers you will receive your receipt and that will be now your "permission to be in the country". I have a 5 year student visa but if you drop out of school you'd lose your I-20 so this receipt from the USCIS would be your new pending status. I can walk you throught the process its hard but definetely worth it!

Good Luck!

Mia

Sorry, one last question. What would we need to do to get a marriage license? How long does that process take? Would we need to do counciling? How does that work? How long did it take you guys...

That largely depends on the state or even sometimes county you live in. No counseling necessary unless you're taking religious wedding in a church that may have its own requirements.

Most likely you will need a blood test but not always and pay a fee and that's it. I got married in idaho so I just needed to take in my passport and my husbands birth certificate, we payed $30 for the marriage license. We had it instantly! We got some sort of counseling cause we got married religiously. Is your fiancée a US Citizen?!

He wasn't born in the US but is a citizen now. He's been living in the states for 15 years. Would this pose a problem? He's already a permanent residence.

As long as your husband is a US citizen, you're fine. AOS on average takes about 4 to 5 months to complete. You need to remain in the US until you receive your AP(advance parole), then you will be able to travel if necessary.

Hello everyone

I hope i am posting in a right forum. i have a question and appreciate if any of y'all can help me with it.

my parents filled I-130 form for me in 2011 and they received the "receipt" under the form I-797c right after that. i came as an international student to U.S with F-1 visa. I want to know am i eligible to apply for form I-485 for adjusting my visa to green card or not? and if not is there any way that i can gain any benefit from that I-130 form that they filled for me in a way that i can get any work permit or not.

thanks a lot
