Ok filed the I-130 after 9 months it was approved in person during an interview with me at my local USCIS office.Got letter a week later after interview .confused. it says that if the person I am petitioning is here in the U S ( which he is not) contact the Local USCiS and file a I-485. If they are not here apply for a I-824..maybe I'm reading wrong but aren't those forms for spouses that are here and trying to adjust status to permanent???? ????

They just entered the info wrong because of ur petitioner interview they thought beneficiary was here.

Just call USCIS and make sure your petition has been sent to NVC and not stuck waiting on something it shouldn't.

Agree with the answer above. May I ask why they interviewed you? They don't usually interview the petitioners.

I think its a more recent phenomenon. It seems like cases that are transferred to local USCIS offices have been requesting the Petitioner to come in for interviews. I had to attend one and at least 3 or 4 other individuals on VJ have as well.

woops.

you need to raise h3ll now, to get the casefile sent on to NVC. The adjudicator made a huge mistake, and you have to chase this down.

Still have your infopass thingie? get in again, beg the guard to let you in,

and talk with that person again. Once you get 'that person', you need to talk to the I-130 Adjudication Unit Supervisor, and tell him/her about the mistake, and not leave till it's corrected.

OR

engage with an Immigration Liason Staffer Human at yer Congressman's office now. They can fix the routing error.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
