How long do I need to main sufficient income?

Hello guys...

I am feeling desperate and upset since my dad has just refused to be our co-sponsor. He doesn't feel comfortable about being a co-sponsor for my fiance and be liable when it comes to money eventhough I assure him that we will never ask him for money. I never ask anyone for money.

My situation is that I don't make 21K in income due to having minimum wage jobs trying to obtain healthcare experience for a graduate school. I recently found out that I have been accepted to a graduate program, which won't start until September of 2014.

I am wondering...Hypothetically, how long AFTER the visa as been approved...from the first day after my fiance enters the United States to marry me that I need to keep a steady and sufficient income? For instance, it is about 11 months from now until I starts school...and once in school I won't even be able to have a job due to the rigorous nature of the program.

I feel so hopeless right now that we will most likely have to wait 4 more years from now before I could file for him independently :(

put these timeticks in your calendar, and plan accordingly.

1. K-1 visa chasing - review/adjudication of the I-134, done on interview day.

2. AOS/greencard chasing - review/adjudication of the I-864, done approx 4 to 5 months after submitting the AOS set after marriage.

See that? It's 2 timeticks. TWO THINGS.

For AOS your income has to be sufficient at both the time of submission and the time of adjudication.

I would study over the meaning of the I-864 and have another talk with your dad. It doesn't mean he has to pay your fiance.

So basically with 11 months ahead before I enter grad school, it is basically a lost cause even if I was able to make enough money until then.

My plan was for my father to be a co-sponsor and that I will borrow out money for grad school which would cover cost of living and expenses...Then once my finance gets his green card, he can start working while I go to grad school for 27 months. We won't even bother my father for money. Now I just feel like 4 years will never come.

another delineation...

The I-134 is not legally binding, but carries a coverage duration (my phrase) of 90 days, the dates on the I-94.

The I-864 IS legally binding..

so, maybe Dad could help out on the I-134, once you explain the I-134 isn't legally binding.

We were engaged this summer. I was planning to go over to London next month for a week of my birthday to visit the city one last time before he moves over here. We haven't filed the I-129, which I was going to finish within this month. I wanted to make ABSOLUTELY certain with my father before sending anything over, which he was ok with at first. Then he became reluctant, which led me to this point right now.

I am not sure what you are asking. Of course we will have to do the papers and do the waiting games. We've got the rings, and my family knows him. We've been in the relationship for over 4 years. It is only the income requirements from my end that I don't meet. That is why I was asking my dad to by our co-sponsor as he makes more than enough for the whole family.

Where is the the $21K figure in? I-864P for two people at 125% is $19,387 http://www.uscis.gov/files/form/i-864p.pdf

@Hank: Sorry,...I had the 21K figure in my head somehow, but I did recheck it yesterday and found that out. Thank you. I am still about 2K short though since I had to cut down my hours half way through the year because my back was hurting so that I could find a different job...Again, for school.

I was thinking perhaps I could sell some stuff on Ebay, but I have a feeling they might not look at it favorably.

The AOS process might overlap with the time I will be in school, that is why if my dad had agreed to be the joint sponsor then I wouldn't have anything to worry about. I've read that some people don't get receive their green card until 9 months after.

When I send in the I-864...Is that just at the beginning, or do they normally go back and check your income later in the process? How long in duration, approximately, am I looking at?? -- is it until my fiance has received the green card?

Just getting dad to sign for the I134 won't work and could be heart breaking if they fail to show income for AOS which would be denied then he would have to leave the US after abandoning his home. The I864 is a scary thing. I wouldn't sign for my children ( although most of them make 6 figures and wouldn't ask )

This will not be over quickly. You will not enjoy this.
