Hey Guys- Quick question,

I filed a I-485 for my wife in August. i received a letter from USCIS stating that her interview might be waived off but the processing will be delayed by another 6 months. Reading the previous comments, this might take much longer like a year.

in the meantime, can i apply for EAD and AP, will it create problems for her GC application. she is currently interning at a place without any pay and they are interested to hire her, they are waiting for her GC.

We dont want to ignore this opportunity.

any help will be much appreciated.

Hello raven52,

My husband received the same letter in the mail couple days ago. We filled for AOS in Aug. Does that mean we have to wait for another 6months or more. I saw an earlier post about someone getting the same letter and the status changed not long afterwards. My husband would like to travel next month, is the EAD/AP good enough for him to return? What other thing does he require to travel apart from his passport.

Thanks for your response

I can tell you our experience was we did biometrics on 10 June in Norfolk

Got the 6 month delay letter in Sept

My wife received her letter stating her GC was approved 26 Nov and herGC arrived 3 or 4 days later on 30 Nov

AP should work well for re entry

I'd carry a certified marriage certificate with me just as insurance

Thanks bxman,

I checked the mail yesterday to see a letter from USCIS. I was excited, only to open it and found out it was RFE. They needed our marriage certificate again which I already sent. My husband's birth certificate wasn't accepted and the need more evidence of our bonafide relationship. It's so upsetting because we have to wait few weeks to get an attestation of birth (secondary) evidence since we are both here. Am just praying that we are able to get this as soon as possible since we are not in Nigeria to get it ourselves.

Thanks.

My wife arrived P.O.E Atlanta, 4-22, married 6-22, filed AOS, 7-2.

Received 797 on 7-10, for I-485, EAD and AP.

Letter today from USCIS office in Lee's Summit, MO. ??????

Her bio metrics was taken in our home state of South Carolina (Charleston), 8-7.

Letter was titled, "Notice of Interview Waiver" saying an interview would probably NOT be required.

Then the strange part.

"Due to work load factors not related to your case, USCIS anticipates a delay in completing your case."

Presently, we anticipate that delay to be approximately 6 months from the date of this letter. (10-16-13) If you do not receive a decision or other notice of action from USCIS by that date please contact our NCSC."

Signed by Robert Cowan, Center Director, USCIS.,.,. BUT was mailed from Lee's Summit, Missouri.,.,. also the letter head address was from Lee's Summit, Missouri.

Has anyone experienced a delay like this on I-485, without it NOT being related to anything we submitted for documentation?

Her file date for AOS was 7-2, received 7-10, and 6 months from now would put us into next April.,.,,how long is all OK, after you file for AOS?

Please, help, somewhat confused and dismayed!

Hi I received the same letter today, and my wife also went through the sputum fiasco in the Philippines. Unfortunately, she was carrying TB and had to go through the treatment. How long did it take for you to get your approval once you received the letter for the possible interview waiver?

BrentV,

It took about 3 and 1/2 months, and GC came.,.,no interview! Waiting 18 months now for ROC>

Good luck!

Sorry to hear anyone that had to go through the ""Sputum Fiasco"" that exists in the Philippines, let alone some kind of bogus, findings.,.,,.I do not trust Filipino officials at any level, ""I"" think the entire govt. is corrupt!

That was a painful 9 week delay for me and my wife...I feel for you, having to go through the treatment, and the Sputum..,but it seems you have overcome all obstacles, again, good luck on GC!

The one thing we ALL share here is the LONG HARD road to be with our loved ones

We all endure the hardship and challenges because in the end it all is worth the struggle

And we KNOW we EARNED our right to be together

It makes being together so much sweeter

And give our relationship meaning

The average wait for an interview waiver case is between 8 and 10 months from your filing date. I waited 10 months. A backlog reduction initiative began a few weeks ago and the rate of approvals has shot up.
