I was wondering if my mom could add my little sister as a derivative beneficiary to her visa application. I have found mixed information online. I am a US citizen petitioning my mother who is currently filling out DS-260 for a visagoofy.gif .

Thanks for your help.

No, your parent cannot have a derivative if she is the beneficiary. But once she gets the greencard she can immediately file a petition for your sister.

No, your mother cannot add your sister to her petition. Derivative beneficiaries are not allowed when a US citizen petitions a parent.

It will take 12 years for you, US citizen, to file for a sibling.

Once your mother is an LPR, she can file for unmarried children. Depending on your sister's age, it could take 2 years or 8 years.

How old is your sister?
