My fiancee and I will be getting married next spring after she enters the US on her K-1 Visa. We will be filing the Adjustment of Status packet(I-485) as soon after our marriage as possible including the I-131 form. We must travel out of the US soon after our marriage because of the sale of a property in another country which will require us to be present. When we fill out the I-131 form, should we apply for a Reentry permit as a conditional resident (we are filing for adjustment of conditional status as I understand it) or for Advanced Parole? It seems to matter since with a reentry permit we can travel when we like and for "non-emergency" reasons while with Advanced Parole we must specify dates and reasons. Will my new spouse not have conditional status as soon as we have been married?

Thanks in advance for any information.

Advance parole. Re-entry permit is something completely different, and is only for permanent residents, which she is not.

As an adjustment of status applicant, she does not need any reasons. She should put "unknown" for dates.

It takes about 3 months to get advance parole, so she cannot leave the U.S. that soon.

Thanks in advance for any information.

Check out the Example Forms, accessible at the top of the forum, for I-131 example. Read the I-131 application carefully, it is used for several purposes. The EAD/AP (I-765/I-131) combo cards seem to currently take 60-90 days to receive after tendering of the applications.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
