First coming from Ghana almost a 100% denial to get visitor visa. Having an active petition on the books for sure will get you a 100% denial.

What strong ties does he have to Ghana to show immigration he would return for his interview? See the issue.

Just regulkar visitor visas for folk not immigrating is slim and none some get through usually showing alot in the bank and very string ties that they will return. Sorry.

I'm with dwheels, almost 100% denial on the visitor visa... my fiance got denied last winter, and then after more research I found that almost ALL are denied from developing countries, including Ghana. You will have to go see him, if possible. He went through with a headmaster of a school with nearly 100k usd in the bank, a large family, a giant house and a bunch of vehicles and he STILL got denied the visitor visa...

I visited, many do. Does he have a Visitor Visa?

Yes, many can and do visit but not from 'third world' countries.. you are from uk so you easily get a visitor visa or don't even need one. It is incredibly difficult to obtain a visa if one is not from eu/uk/aus/canada/a small number of other countries in the world (I think a few east Asian countries have a visa waiver program they can come through on?). Ghana is a different story, visitor visas are rarely granted. Last time I checked the stats for embassy in Accra 99.7% were denied... very sad, especially for people who think they will get it (like me/my fiance :( )

If he has a Visitor Visa or can use the VWP should not be a problem, OP never said either way.

Thanks everyone for your responses, This is a very hard process, I hope this process hurries it's been 7 mos and I know we still got sometime to go :(

Simply put, if he already holds a visitor visa (B-2), there's nothing stopping him from getting on a plane to the US, and hoping the CBP will let him through. If he doesn't already have a visitor visa, this will be a near impossible task.

Only way to do it is for him to apply for a visitor visa at the embassy in Ghana, and show evidence that he will certainly have to return to Ghana at the end of his stay. This is very difficult because if he is already married to you, nothing would stop him once he is in the US to file for adjustment of status and stay.
