I am 43, I met my wife in her country on the last day I was to be there after almost half a year of working there. I went there at least 5 times in two years to see her, be with her, meet her family, friends before we took the K1 step. I to this day do not believe SHE came here with the intent to use me and never will, I sadly helped put her in a position that others could advise her on how to claim abuse and well it is what it is, I hope it works for her. As for how we planned on building our family here, you are very much close to what we were trying to do. the bad outcome in the end, could have been avoided by better communication, more time to think, more space given to relax, so many factors and in the end NOT giving her that ticket. Had I not done that this thread would not be here.

I my case I hired a lawyer, since I was not in the same state, and in reading posts in other sites related to fighting these orders, the majority said hire one. I did trust he would do all of the proper fact gathering and present the best defense possible, but once in court as it went along I noticed he was not as ready, prepared as he should have been and I had warned him about things she might say, thankfully due to access to some of her text messages. In court we tried to prove, I was not a threat, I have the responsibilities of my children's support and could not risk losing my ability, freedom to do so due to a failed marriage. I understand the angle on the AOS motive and some of your other points.

I may appeal the order on my own, after more research and fact gathering to determine if I can present my case better, within the limits of the court. There was just too much not done properly and I can not have this on my record. The call(s) the night after she left are not helpful either, but I must try to clear my name at least at the court level since I can try. I put in the appeal notice to ensure that deadline was not missed and I am researching, putting my defense in order and thinking if it is really worth the attempt. In the end should I lose it can not be any worse.

As for her, there is nothing else to be done there.

The judge will almost always grant to protective order no matter what. If she ends up dead the judges don't want that coming back on them.

Plus judges are lawyers, so their lawyer buddies (your lawyer) gets to make a few bucks in the process. While the legal system is supposed to be about fairness in this country, fairness takes a backseat to dollars.

Best bet is to move on and forget about her as quickly as possible.

So SingleDad, a citizen of Canada, how did you meet your Eastern European wife? How did you come to bring her to the US? Did she have a visa or just slip by customs in the car with you? How did you come to stay here long enough for her to give birth to two children? What prevented you from returning to Canada prior to the birth of the second child? Why did she decide to leave you? Why did you feel the need to try to "force" your wife to remain in the marriage when she made it clear she did not want to remain with you?

Have you obtained employment now that you have had your EAD for months or you just worried about getting as much in public benefits as you can? BTW your wife has never been court ordered to pay child support and even if she was it would all go to the state to reimburse them for what they paid your children in benefits.Great you raised two kids without a spouse. Lots of people in the US do this everyday. Considering you raised to kids by yourself by living on their benefits and never working yourself, that is great.

It doesn't feel so good when someone grills you wanting all the dirty details of your life. So please stop doing it to others. People come here for support not to air their dirty laundry and be given the third-degree.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
