Because my husband spent Easter with us, here in Portugal, we were thinking about me travel there, to the US, for the holidays and for the wedding of one of my brother-in-laws (i already missed one wedding).

But as we have the I-130 going on, since April, what should i do? Should i request some kind of special non immigrant visa and the american embassy? Or just go with the ESTA (tourist visa)?

I am also in this situation, my husbands I 130 is processing, but I was thinking if he could still apply for something to come here to US for like the Holidays

He can apply for a tourist visa but the chances of him being issued one are next to nil.

I asked the embassy where my wife lives and their response was...

Kindly note that she can apply and the officer will decide at the time of the interview whether she is qualified for the visa or not .However her chances are very few .

I concur....chances of getting approval for another type of visa are highly unlikely and could cause red flags. If you are in a country that is in the US VWP, traveling to the US on just a passport (shouldn't) be a problem...but caution is high to not attempt to acquire another type of visa otherwise.

Hi, i received an answer from the embassy:

"Dear Madam,

If you are going to the US for a short period of time, the ESTA is appropriate.

Probably, there at the Port of Entry, the Immigration Officer will ask you why are you entering as non immigrant if you are in the middle of immigrant visa process.

I don't know if this applies to your husband also Nanasa. So Now i'll just have to convince the immigration officer that i just want to spent the holidays, nothing else.

Hello i got a tourist visa the last week my husband filled the papers in august and I just applied and they gave me the visa for 10 years (:

Did you remember to indicate you have an ongoing immigrant petition in your visa application? If yes, then indeed you had one of those few chances talked about, which now leaves remaining chances even fewer and less by one.smile.png
