There is another forum here for when things go wrong. There isn't enough info here for anybody to help you. They would need to know if you are the immigrant and where you are in your quest for adjustment.

I came here on k-3 visa about nine months ago.she even removed my name from thesame account we both had together and at the same time she sign my paycheck without my consent.she left a letter that I should never come back to her houe,right now I'm staying with a friend on mine.I have a copy of voucher paid for my hotel accomondation by the salvation army.Oh sorry I'm the beneficiary

You can try to adjust status as the battered spouse of a US Citizen. I am not gonna look up all the rules on this right now, but if you go to www.uscis.gov and do a seacrh on battered spouse, you should be able to find the information. You need to prove that you were abused. you should probably try to find a free immigration clinic and/or some sort of social worker who might be able to help you with this process. Other than that, you might want to consider returning to your home, if you feel that your marriage has no chance of working out (doesn't sound like it does).

The self-petitioning spouse,

Must be legally married to the U.S. citizen or lawful permanent resident batterer. A self-petition may be filed if the marriage was terminated by the abusive spouse's death within the two years prior to filing. A self-petition may also be filed if the marriage to the abusive spouse was terminated, within the two years prior to filing, by divorce related to the abuse.

Must have been battered in the United States unless the abusive spouse is an employee of the United States government or a member of the uniformed services of the United States.

Must have been battered or subjected to extreme cruelty during the marriage, or must be the parent of a child who was battered or subjected to extreme cruelty by the U.S. citizen or lawful permanent resident spouse during the marriage.

Is required to be a person of good moral character.

Must have entered into the marriage in good faith, not solely for the purpose of obtaining immigration benefits.

See it's not that easy. I have no idea what country you have come from. I really think (as I said before) that you need to try to find some legal help with your situation. Maybe the Salvation Army can refer you to someone who will help you for no cost.

Look up the nearest Catholic Human Charities office in your area, and make an appointment to speak with them about pro bono immigration assistance in order to file a VAWA claim. Better to do this now, rather than later. Try to secure affidavits from anyone that witnessed what your US citizen wife did to you, during the 9 months you were here, that was in any way abusive. Preventing you access to home and board, prohibitting you from contacting family members and commandeering your paychecks for her sole and personal use is abusive. It doesn't matter that the divorce petition has been filed, but you must submit the VAWA claim ASAP, in order to receive a determination quickly.

Does that mean if things did not materialised she should put me behind ber for the offence I did not commit.Have you ever being to jail? did know that I was jailed innocently? think of this.she hould have let me go in peace rather than put me into place I was not belong to.I have every evidence that i was abuse mentaly.what would you do if this happened to you? tell me what would you do if your wife sing your paystubb and diposited the money into the account that your name was removed from?

Many thanks for your advice.but I'm not staying with her now I left WI.do you think I can still file for under VAWA?
