Double registration of birth certificate

Hi everyone!

Hope this finds everyone well. I would like to ask your advise on what's the best thing to do about my situation. My fiance has already received NOA2 for the K-1 fiance visa petition he filed for me. I already started gathering the necessary documents and found out that I have 2 registered birth certificates at the NSO here in the Philippines. The 1st is under my father's surname. The 2nd one is under my mother's surname and the father is written as unknown. I have always been using the my mother's surname and I have always been getting that from NSO. But now, they issued me the 1st registration that I did not know exist and they do not want to issue me the 2nd one that I have always used.

I have read a similar post from years ago but I cannot reach the person who posted it anymore. I thought of having the 1st registration cancelled but I was advised that it may not be possible or even if it could be done it might take 1 year. Would an affidavit that I the person on both registrations are one and the same do?

Please help us. I do not know what to do as my fiance has already received NOA2 and we are now just waiting for the letter from the embassy here in Manila for the next steps on what documents to prepare and the interview.

Sound like lawyer time to me... I don't know a simple solution to that.

Not sure why NSO refused to issue your birth certificate under the name you always used. To me the birth certificate they issued to you would have a different last name then what you have on the other birth certificate... so I would tend to say ... THAT IS NOT ME.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

She must have an NBI with AKA as well.

Hi..I am the beneficiary. It happened to me..1999 I found out that my live birth certificate was not registered in NSO. When I proceed to LCR I learned that the records from - yr to- were not existing anymore because of a fire which destroyed the records. In short,it caused the late registration of my live b.c. I used it from that yr up to year 2012.When my fiancé filed k1 petition on Sept.2012, I requested 7 copies of my b.c. Sadly, they issued my original b.c. which has differ birth date. N.S.O. legal assistance advised me to hire a lawyer and file a petition. We did.. I chose my late b.c. and process took almost 4 months. We paid 37 thousand pesos. We had very long 2 & 1/2 yrs in our long distance relationship and we'd waited for almost one year before our k1 and k2 got approved. We had waited patiently for this precious moment, we got married last Sunday Oct.20 here in Alabama. I'm just shared my sad and happy moments to you, vj friends. God bless ..

Thanks for the help everyone!

@kcbowhunter - Congratulations and best wishes! Did your birth certificates have different surnames? Mine have different surnames and I have been advised that it may not be possible to cancel the 1st one. I am still at a loss on what to do.

I found someone here that has a similar situation. But I can't seem to contact her. She's only posted the same situation last month. Any of you know how?
