My brother-in-law who is a US citizen wishes to petition his girlfriend & their 1-year old child. He wants to go for the K1 route.. Now my question here is what about their child?

As far as their child is concerned your brother is allowed to petition for all of her children under 18 or maybe 21 even if not by him ( your brother ) it is as simple as an extra form with the childs info, but also they will need passport, birth cert., etc for the child also.

october 29th 2003 - met Jenny on my first trip to Phils.

december 25th 2003 - visited Jenny again for Christmas :-)

feburary 23rd 2004 - visited once again :-P

may 23rd 2004 - visit again 4th time, stayed 3 months with my sweetie.

novem. 23rd 2004 - visit again, stay 3 months again.

may 26th 2005 - sent I-129f to USCIS

June 10th 2005 - recieved NOA1

august 28th 2005 - recieved NOA2

sept. 20th 2005 - Manila, Phils. embassy recieves our case.

novem. 23rd 2005 - visit my sweetie again :-)

january 10th 2006 - Recieve packet 3 from embassy

feb. 23rd 2006 - interview in Manila (both attended the interview) AR!!! march 17th 2006 - Visa in Hand! yaaaaaaaaeeeeh!

April 6th 2006 - Flight to the states.

July 26th 2007 - Filed for AOS

November ? 2007- RFE for tax papers

November ?2007 - sent in Tax Papers!

March 28th 2008 - RFE for Insufficient income need Co sponsor

June 27th 2008 - Send in Co sponsor papers

July 8th 2008 - RFE for Medical (TB testing redo)

August 8th 2008 - Card Production ordered.

If he is the child's father and was a US citizen when the child was born, the child is probably a US citizen and does not need a visa.

They just need to register the child's birth with the local US Embassy and get the child a US passport.

uh huh but the thing here is they are requiring him something like a 5-year domicile here in the US but he couldn't prove that because most of his time was spent in the Philippines... plus they are requiring him to do a paternity test but since he is now the army, he doesn't have time to go back in the Philippines so that made him decide to just petition his child...

What does a K2 form look like? Is there such a thing?? What are the main requirements of a one year old child? Do they both need separate affidavit of support??

There is no K-2 form. The first thing he has to do is file an I-129F petition with the USCIS. The petition lists both the beneficiary (fiancee) and her child all on one form. At this stage no additional information is required about the child other than to be named on the petition.

Only one affidavit of support as it will cover both.

for the child, he needs to get him a consular birth abroad and then for the girl, he needs to file a k-1 visa
