Hello,

I am a US citizen and my husband and I got married 6 months ago. He currently has an H1b visa and works in the US. We are now about to file his AOS application for him to receive his green card through marriage.

We are planning to submit the following forms:

G-325A (for both myself and him)

I-130 (from me)

G-1145 (from him)

I-485 (from him) with option (a) checked off

I-693 (filled out for him by a USCIS approved doctor)

I-864 (from me)

In addition, his H1b visa expires on Dec 31, 2013 which likely will be before his AOS is approved. Based on what we read online, he needs to file I-765 to be able to continue to work after Dec 31, 2013. And, after Dec 31, 2013, he will not be able to leave the US without abandoning his AOS application.

We have concerns in three different areas:

1) Are the forms that we are planning to submit for him the full required list?

2) Is I-765 the only form he needs in order to be able to continue working? Is there anything else he should do in order to extend his legal right to remain and work in the US? Is he allowed to switch employers after his H1b expires and before his conditional green card is approved?

3) While he is waiting for his conditional green card, is there a way that he can travel outside the US and return without "abandoning" his application and without re-entry problems? If so, are there additional forms we should submit?

Why did you check option A on form 485?

Does he have an immigrant visa number?

It seems to me that option H is the one; with statement 'Marriage to USA citizen.'

But I am no expert; perhaps other will comment.

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

Why did you check option A on form 485?

A is the correct choice for the I-485 since he is filing the I-130 at the same time.

Option A requires some prior authorization paperwork and numbers that I doubt they have.

But, if you are correct, can you direct me to a statement in some Instruction Form that states this. I will be needing to choose a box also for a person trying for AOS from F-1 visa. It seemed to me that H would be the appropriate block with statement 'Marriage to USA Citizen.'

Maybe if I-130 filed alone first, and then some numbers are given in return, then something would be available to be able to check block A on a subsequent I-485.

Yes, the actual form and the I-485 instructions state this. You check a.

From the I-485 form:

a. An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

1. Based on an immigrant petition

You may apply to adjust your status if

A. An immigrant visa number is immediately available to you based on an approved immigrant petition; or

I see it now, but that wording is pretty obtuse !!

Hi!

I'm of no help as far as answering your questions, but just wanted to say that I'm in almost the exact same situation, and have listed out the same documents as you. We got married only 3 weeks ago and my H1-B expires in January of next year. We are hoping to send in the AOS packet within the next two weeks. Very confused and overwhelmed with all the small details of filling out the forms and doing everything right!

Adjustment of Status from H1-B
Back story: I have been in the U.S. legally since 2004. Visitor visa, F1, OPT, H1-B, and now finally at the end of my first 3 year visa, I found the Love of my Life.

July 2, 2013: Started talking on an online dating site.
July 5, 2013: Went on our first date! Ocean front, cocktails, magic, fireworks, closest thing to love at first sight! We've been inseparable ever since!
August 8, 2013: He asked me to marry him!
October 5, 2013: Our wedding day! Beautiful beach wedding with small group of friends and family. Exactly 3 months since our first date

November 19, 2013: Mailed I-130 & I-485 to Chicago lockbox, via USPS with signature confirmation ($9.65)

November 22, 2013: Packet arrives at the Chicago Lockbox, notified via USPS tracking

November 27, 2013: NOA received via text message

November 30, 2013: NOA hardcopy arrives in mail

December 12, 2013: Biometrics Appointment letter arrives in mail, appointment date Dec 30th.

December 17, 2013: Walk in Biometrics Appointment at the Honolulu Office

December 31, 2013: Text message/email that my case is updated, now in the "Testing and Interview" stage and should be scheduled for an interview soon

January 28, 2014: Text message/email notification I765/EAD card is in approved and in Card/Document Production stage. I131/AP is approved, and in Post Decision Activity Stage

February 6, 2014: After calling the USCIS to follow up, finally received a notice that they have mailed my interview appointment notice!! March 10th!

March 10, 2014: Interview! Prepared with a lot of photos and extra documents, but all she was interested in aside from normal questions was the photos. (Better overprepared than not at all!) Got an email about an hour after the interview with an updated USCIS status... APPROVED!

March 22, 2014: Green Card in the Mail!
