You cannot promise to bring tax documents on interview day. If you send in the I-485 without the I-864, you will be sent a RFE which will have a time limit on it. If you can't get the documents by that time limit the I-485 is denied.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

All I am waiting for is the Itin number W-7 for my wife then I file. They said it will take 6 weeks but am planning for 10 which puts us before the date my wife has to leave of Jan 20, 2014. They say it takes 3-4 months to process the return but I can just send in copies of what I filed and take the transcripts and copies to the interview maybe I will be ok. I guess the RFE will tell..

I guess we all make mistakes and I have made mine in this process.

Why don't you file married filing separately for now, then amend tax returns with wife's info later?

Then I would owe taxes and then would have to deal with getting them back after I paid them. More simple to wait for the W-7. When we lived in Panama we could have applied for her W-7 a few years back but it meant sending her passport in and waiting 60-90 days to get it back which we did not want to do from a foreign country. Doing the returns I knew I owed no taxes and thought I would wait until I returned to reside back in the US which I have done as of a few months ago. I will probably have to pay a late filing penalty.

nah, if the IRS owes you money, there is no late filing penalty, for 3 years.

I could, of course, be wrong, but

the IRS gave us nice 'extra' monies for interest.
