Filed an I-130 yesterday. Advice on AOS please

We decided to file the I-130 and later file and I-485 and I-864 due to financial reasons. My wife has 3 months out of 6 left on her B2 visa. On the I-130 we stated that we will be adjusting status.

We have been married over 3 years and now I am living in California as a resident. She did not visit here for the purpose of adjusting status but we decided to after some thought. She had an airline ticket to return on October 28 which we just cancelled a few days ago.

My understanding that before the I-130 is approved, we can file the I-485 and I-864. Does anyone concur with me on this? Also probably since a acceptance would not happen by that time she has to leave can someone tell me how it is done. I filed the I-130 through the Phoenix address. Do I file the I-485 through Chicago Lockbox and since I probably won't have an approval number how should I relate them.

We filed the I-130 yesterday with $420.00 To file the I-485 it takes $1070 more which we will not have until next month. So in order to start the AOS process I need to file the I 485 before January 2014 when her visa time runs out. I was just anxious to get the I-130 filed so I did.

My question is this: Do I need approval of the I-130 to file the I-485 Adjustment of status? I have been told I do not but want to verify this with other members. Thanks

i-130 will be pending for at least 10 months.....file for Adjustment of status and work permit before her stay expires

10 months really, I thought it took 2-4 months ?? How do I file the AOS without a I-130 appproval? How do I reference the 2 filings?

when you recieve the 130 notice in mail next week send in a copy with -i485,i131,i765,i864.....file all of these forms together along with g325a for you and your wife


if you file all together its only $1070

Do I file again in Phoenix or do I file in Chicago lockbox. I did not see where you filed an I-130? did you? Why did your process move so fast?

File a copy of the NOA1 for the I-130 with your I-485 package, as stated above. They will match them up and your spouse should have a green card in 3-5 months. I-130 approval can take a long time as part of a family visa process, but not for AOS once the I-485 is filed.

By filing the I-130 alone you did not start the AOS process at all, or gain any time, or gain any protection in any way. Your AOS clock will start when you file the I-485. Include a copy of the NOA1 from the I-130 so it will be turned into a concurrent case.

You are a US citizen and not an LPR, right?

My understanding is that if you are an LPR it will take them longer to process your paperwork.

There is no point to "start the AOS process". If you don't have enough money to file I-485 now, then you should wait until you have enough money to file I-485, and file I-130 and I-485 together then. Filing I-130 now gives you no benefit.

Sure - if you are a USC, it makes more sense to do this.

I've got a question in regard to this forum. I'm about to start the filing process with my spouse we've been married for 6 months. Is it better to submit the I-130 form first or is it better to file it together with the I-485. Also, regarding the medical exam, is it better to file it together with the I-485 packet or is I better to wait until it is requested?
