Hello people of this forum I have a question....my co-sponsor doesnt have the 2010 tax form do I need to send it with the whole package? or what kind of evidence I will need from sponsor? thanks I need advise on this part of the journey

Hello. I have been following you cause my honey is in honduras also so hopefully you post how your interview goes. Pple correct me you should be ok without 2010 taxes but need around two months check stubs I 134 employment verficatiin. I don't need a sponsor but I am also missing my 2010 taxes so I am just going to send him everything else. I wish you best. We have a lot more to go cause my honey is banned for ten years but we were just approved for our I129 fiance petition. So I feel we won't meet the embassy till January. Good luck.

Haha I am the girlfriend. I just couldn't get a photo of us to upload. It is a headache. I studied and studied. I filed myself but I know we will need a i601 because he was here illegal. I just have to get him out of honduras cause of the poverty. I constantly have to send money to pay lights food ect.. hopefully we qualify for extreme hardship. When yall have your interview can you post how the people are and how it goes..

Co- sponsor does not have to provide tax return or tax transcript for 2010 its optional. Co-sponsor must provide last yrs tax transcript (2012) or income verification and any pay stubs from 2013 if it proves that income in 2013 is better then 2012.

Hi It all depend how long he was illegal for in the US and how long ago if he was illegal and stayed for less then 1 yrs then ban is 5 yrs. Also other factors may come into play... Maybe you like to discuss your case with an immigration attorney and if you do need I-601 then start preparing now. good luck.

He was here five years. He got arrested for dwi and failure to show info. But he has never been in trouble with immigration. He left two years ago on his own. I talked to a lawyer. I was told I could apply after our approved petition. But I am drained of money. I am just paying off a cow just so he can have milk to sell. I still have to pay for passport, medical, and appointment. So I was goinf to wait till after the interview to hire the lawyer. I have thw I 601 ready but I am just scared to do it alone. Now what do you think? He has no proof that he was here that long but we were honest on our I 129f.

One more thing. I went to see another lawyer. He told me I couldn't file the I 601 because we were are not married. But it states clearly in the direction I am the perspective spouse for a k1 visa .it says see special instructions. Was the lawyer wrong? I was angry I showed him the directions but he didn't care he just got really ugly. So can a fiance for k1 apply for the I601?

If you are inadmissible to the United States( Which may be the case with your fiance ) and are seeking an immigrant visa, adjustment of status, certain non immigrant statuses or certain other immigration benefits, you must file this form (I 601) to seek a waiver of certain grounds of inadmissibility.

K1 and k2 visa applicant can file for I 601 who is outside US and who has had a visa interview with counselor officer and was found inadmissible. Has your K1 petition been approved? You have to Waite till your fiance had a visa interview and found inadmissible.
