dilemma. help please :(

i've known my fiancee since we were kids.when he left for the states i haven't had communication with him since.

i've had my fair share of relationships then, i have 2 kids with my ex boyfriend in 2006 and 2008, and separated in 2010.

my fiancee(childhood friend) on the other hand also had relationships, married his now ex wife obtaining him permanent residency. But In 2011, his wife talked to him about separating and that she was getting back together with an ex boyfriend, this is where i come in, my fiancee came to visit the philippines, we met and i got pregnant with our daughter while he was separated of course but not yet divorced, when he came back to the states he learned that his wife was also pregnant with the ex boyfriend's child so they got a divorce and was finalized in 06/2013. now my dilemma is this, i have read that since i am from a high fraud country i/ we/the relationship might be scrutinized since i have known my fiancee before he went to the states and that i might be blamed for their separation/divorce. i am not the reason of course since it was his wife's decision to leave and that was before i came into the picture. also he obtained permamnent residency (he became a naturalized USC while serving in the military) through marriage to a USC his marriage might be scrutinized. I have been bothered by this since we decided to file for i=129f. I think i might be having an anxiety attack. i am scared to check the status of our petition and i dread the day of the interview if there would be one. sad.png

Does your fiance have filed I-129F after his divorce was finalized? One of requirements is you both are legally free to marry.

As to the concern with Visa Fraud, what they are examining is if the relationship is involving petitioner and beneficiary is bona fide- as opposed to being made up for the purpose of an immigration visa. Even if on the surface it might look as if ‘you are the other woman’, it doesn’t necessarily equate to visa fraud.

Although this was a number of years ago, my husband’s grandfather and grandmother divorced after 50 years of marriage because his grandfather was having an affair with a woman young enough to be his daughter. He later married her and petitioned her for a marriage based visa ( I am guess it was a AOS since she was already in the U.S.) So, if they were successful despite the moral and ethical transgressions of their relationship, I really don’t think you have much to worry about.

Although, because you are not married but currently pregnant with his child, my guess is that they will likely require a DNA test in order to process the CRBA for your unborn child.

I don't see any reason why it could be a problem since he is already divorced. Just have to make sure that you have all the papers. Also, there is usually a wait period before remarrying in some states after divorce. You might wanna check that out.

I am not an expert, I have read the whole story of yours and I am definitely not seeing something that hold your fiance I-129F up. As long as you sent all proper forms, supporting documents, etc, I think you will be fine. There are a lot stories with complexity on VJ and most of them got approval for I-129F.

But, you need more insight from Filipino fellows here to give you a better idea how to deal with USEM after your I-129F got approval and forwarded to embassy. Good luck.

Hi Mae! My fiance (USC) is my ex bf in HS. We became a couple again in 2011, and got engaged in April 2013. His divorce was finalized in May 2013. He was separated from his ex wife a year before I came into the picture. We just filed our I-129F last month. The requirement is both of you are legally free to marry at the time of filing. If asked in the interview, just be honest and tell the truth.

Why worry if your relationship is genuine? As long as you can prove that without any doubt, it is true then you should not worry. Make sure though that if he petitions you it wont appear to be a rushed one. Goodluck.

Timeline

Your relationship would be scrutinized even if you weren't from a high fraud country because of the complex nature of it. Now I'm not saying lie to uscis, because lying never fixes anything in the immigration process, but don't over share information in the process of your k-1. For example uscis doesn't need to know your fiancé got you pregnant while he was till legally married or that his ex wife got pregnant by an ex boyfriend. Give very specific answers to their questions in the paperwork and for the interview.
