Hello VJ members,

Here is the thing. After i get my greencard via F1 category, i want to apply F2A for my gf.

Would it be viable if she travels by B2 visa and get married with me in US. Then, I will start our F2A progress.

Or should i have to go back to my own country to get married?

A B2 visa is not intended for getting married in the US. Be careful what she says to CBP.

If she manages to enter the US via B2, you can get married but later on she has to go back to her home country. She cannot stay beyond the limit of her B2. Overstays are not forgiven for relatives of green card holders.

A B2 visa is not intended for getting married in the US. Be careful what she says to CBP.

We do not intend to overstay in US. Therefore, In your opinion, is it better for me to go back to my own country and get married with her?

In our case, she visits me and get married in US is a bit more convenient. I do not need to go back to my country just for the marriage. Meanwhile she is in US, we can both spend some time in the city where we will live in the future. By the time B2 visa ends, she will go back and wait for our F2A progress.

But i am aware of what apple21 said before, "A B2 visa is not intended for getting married in the US. Be careful what she says to CBP."

Yes, it is. She is visiting you/she'll be there on vacation and that is all.

She doesn't have to be like, "Oh, I'm here to get married to my boyfriend." Sometimes they don't even ask the purpose of ure trip, but just how long you intend to stay and the address.

It's when ppl go with the intent of getting married, STAYING and then adjusting their status is when there will be a problem.

Besides, her over staying would not be to her benefit at all. She can stay as long as she is allowed (6 months is the max the officer will grant.)

Moreover, in my case, that is exactly what my boyfriend - a green card holder since 2009 by virtue of ure category as well (F1) - and I are going to do. I have a B1/B2 visa and I'll be taking our two children back to The US (they also have their green cards). I'll be visiting for Christmas and we are going to get married, start our filing and then I'll come back home.

I'm the "documents specialist" in the family, so I'll be the one assembling the package! I'll explain the process to him and he'll sign the relevant forms. :-)

Of course he'd love if I didn't have to leave again, but he understands we have to wait. ~~~
