Hello VJers! My wife is tired of waiting for the approval of I-130 which she filed on my behalf after 5 months of waiting.

She is thinking of coming back to the country to stay with me until the eventual visa approval. Can USCIS

transfer our I-130 processing to the Consulate office so that we can follow it up from there. Are there any pros & Cons

to this idea? Is it workable?

No. After USCIS approves your i-130, it will be forwarded to NVC. There are fees to be paid, affidavit of support and civil documents to be sent to NVC. Once you have completed the NVC stage and an interview schedule has been set, that's time NVC will forward your case to the designated US embassy/consulate.

The petition will be transfered to the consulate/embassy where you are located. If your wife moves out of the country, she would just have to file a change of addresse for her with USCIS.

It's amazing how many questions can be resolved with a 2 minute Google search...

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

thanks for your responses. Just to be very clear. We have our AOS ready for submission as soon as I-130 is approved. Where the confusion lie is that if my wife return to live with me while we await I-130 would the process take a new dimension (as Direct Consular Filing) because she does not want to return to America without me as we have a foyr month old baby whom she alone has been taking care of.She needs support in raising our baby.

You cannot shift to DCF because the i-130 has already been filed and currently waiting adjudication at a service center.

Your wife can stay with you, no issues with that.

I know how she feels! I have been living with my husband abroad for the most part of the last 3 years because I just can't imagine spending all this time away from him. We just filed the I-130 in May of 2013, but we've heard nothing yet and its getting aggrevating. The time we are spending together while waiting, however, is priceless...so if she can stay there with you abroad, I would say go for it.

is your wife planning on keeping the house/apartment in the states when she moves? Is she completely moving to Nigeria, or just coming to stay with you on a visit while you guys wait?

I don't know your financial situation but will her moving effect your AOS (sponsorship) ? I think if she is coming to stay for a visit it wouldn't really complicate things but she may just need someone as back up to be checking her mail and helping in case you guys forgot something here in the states.

I completely understand though having a baby and your husband not being around to experience it with you due to this process ( the worst feeling), so I hope she can come and stay with you while you guys wait.

She is been staying with her cousins in New York and we are hoping to get our apartment as soon as i move in.

There is no DCF in Nigeria,hence she had to be domiciled in the US but she can no longer handle the separation.

She would be coming back to stay with me in Nigeria until the eventual visa issuance. Would we call that a visit or

relocation since hadnt any personal apartment. She had some certifications all in a bid to secure a job while we wait

but i dont think that would be possible cos she is bent on coming to stay with me. She recently got her driver's permit.

If this could be seen as visiting,how long can a visit last?
