Hello All,

My sister and my brother-in-law entered U.S. on a B2 visa last week. They were granted a 1month stay. My brother-in-law has ALS (Lou Gehrig's disease) While they were here we made an appointment in the hospital I work in with a top neurologist. He qualified for a drug-trial and started his treatment. Only problem is he has to stay here for 5 more weeks and get a check up once a week in that time. After that, check ups are once a month for 3 months. He is planning to stay here and go back and come back once a month for the check-ups. They do not want to do anything illegal by overstaying their granted time. I know I can file I-539 to request an extension. But USCIS site states it might take 45 days to get a response. Their passport states they need to return on November 14th but their last visit is going to be on the 19th. Is there way I can go to a immigration office to extend their stay? I live in NYC and I know there is a immigration office here.

In addition I remember couple of years ago when you entered U.S. as a tourist they stamped a form on your passport and took it back when you exit the country. I see that they do not use this form anymore. If they over stay their visa by a week, how would they know? Would they have a problem coming back for the next visit in December?

Any guidance will be appreciated.

I can't answer your question in full as I don't know enough about B-2 extensions, other than knowing that it is generally possible for medical reasons. Maybe someone else will chime in on that.

As far as the I-94 that used to be stapled into the back of the passport - This is now electronic, and I believe updated once his passport is scanned for the return flight.
