i751 Packet Returned From VSC

Hello,

Last month I got a notice from USCIS of requirement to file joint petition to remove the conditional basis of an alien's permanent resident status.I have sent my petition to remove condition on residence and all supporting documents to Vermont service center on October 07.Today I received my packet back from VSC with a letter stating "A review of your USCIS record show that you were incorrectly admitted as a conditional resident.You should have been admitted as a permanent resident without conditions because the marriage through which you gained status was entered into more than 24 months prior to your admission.etc...."

What I understand is that I entered USA after my second marriage anniversary and was supposed to get IR-1 instead of CR-1.I even told CBP officer that at the time of entry and he told me that USCIS will correct the status and you will get 10 year green card however I got 2 year conditional GC.I didn't give much importance to replace my GC because I was tired from dealing with USCIS.

Now am going to fill form i90 to obtain a permanent green card .

I know, being the government, that it might not happen, but it was their error (and they've admitted as much). Maybe you can convince them to waive the fee for the I-90 since they should have given you a GC good for 10 years in the first place. It's worth a try.
