You won't get a work permit because you didnt file a I-765. You may do so sending a copy of your NOA along with the application and you wont need to pay the fee, you may do the same with the I-131. If your Green Card interview is coming up dont worry about filing for EAD cause your GC will be your work permit also. LEss Hassle.

Hope this helps.

Mia.

Then you are adjusting from a student visa and I am going to send your thread to the appropriate forum.

My student visa expired 4 yrs ago and I have bn out of status. Then married my wife

Yes. You entered the US with a student visa. You are adjusting from the student visa, which is what you would have put on your I-485 for your current USCIS status. You never had a family based visa, which is why this is the appropriate forum for you. There are differences in the process for a family based visa adjustment. For starters, when someone is adjusting from a K-1 visa, they do not file an I-130.

How much is the fee when you only sent in you I-485 and I-130? was it 1070?

Also you can still apply for AP and EAD after?

Thanks smile.png

The fee for the I-485 is $1070. The fee for the I-130 is $420 Check the USCIS instructions for form fees.

Yes, you can file for the EAD and AP after. Just include the I-797C receipt notice from filing the I-485 with your I-765 and I-131 forms.
