Hi everyone

I am still waiting for my AOS to be processed but have my work visa which expires in mid February 2014. I came here on a K1 and married within the 90 days.

What form do I need to send in to get the work visa extended.

It doesn't seem like anything is happening with my AOS.

Many thanks

Do you mean you got your employment authorization card based on filing for AOS? Or did you have an actual visa for working in the US prior to getting the K1 visa? It would be easier to answer your question of you would fill out your timeline with dates.

I am going to ASSUME that you had a valid work visa that is going to expire in February 2014. I am hoping you filed the AP/EAD with the AOS as you should get those in a couple of months after filing the AOS. If not, you can still file the EAD/AP for free by including a copy of the NOA1 from the AOS. Once you have the employment authorization document (EAD) the employment visa does not matter any more and the EAD is valid for 1 year or until you get the GC, The advance parole (AP) will allow you to travel while waiting for the GC and it is a just in case an emergency comes up and you really need to leave the US while the AOS is pending. The AP will allow you to re-enter the US.

Good luck,

Dave

I am confused here. Maybe a stupid question. In the process of getting my fiancee's visa but i was told he cannot work when he enters the country. He's coming from Brazil. It's been approved by USCIS and transferred to NVC but we are still waiting on appointment etc. I am reading on the NVC site that he gets a temporary green card that expires a year from entry. He had never lived or worked in the USA. Which is true?

February 13, 2011 I met the love of my life!!

February 21, 2013 He proposed in Rio de Janeiro at Ipanema Beach Post 9!!!!!

May 1, 2013 Petition mailed to USCIS
May 3, 3013 Petition Received by USCIS
May 7, 2013 NOA 1
September 11, 2013 Text and email saying USCIS APPROVED
September 13, NOA2 received

October 23, 2013 Consulate received and later that same day marked as READY
October 31, 2013 Packet 3 &4
November 27, 2013 INTERVIEW DATE!!!

If he was already married he would receive a temporary green card stamp in his passport. He is entering on a non-immigrant visa so no stamp. He cannot work until he received EAD or Green Card. Please start your own topic and don't hijack another thread.
