So we were initially going to adjust his status through the court, as a derivative beneficiary to my 245I. But instead his removal proceedings were terminated and we are waiting for an interview with USCIS. We had already filed for AOS through Texas service center. His advance parole was denied because he was in removal proceedings. So basically my questions is if he can just reapply for advance parole and sen it with the letter from the judge stating his removal proceedings were terminated? His attorney said that we have to wait for the file to get moved but i dont see why they cant just reapply for another advance parole,and would we have to pay a fee? Thank you.

Sep 7,2012 : Text notification update: On September7th we mailed you an appointment notice for an interview for October 10,2012!!
Sep 10,2012: receieved interview letter in the mail for October 10 at LA field office!

May 6,2013 : Recieved email I-485 approved

May 10,2013: card document production ordered/ received Welcome letter

May 16,2013: Received Green Card in Mail!

If he had an overstay, which I am guessing he did, the AP will not guarantee his re-entry.

I suggest he not rely on Advanced Parole at all, instead,

don't leave the USA till greencard in hand.

You've a 'tough' case - we don't deal much with 'tough' cases here - suggest you read a lot over at http://immigrate2us.net and then when yer ready, post a question there.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
