Hello folks,

Approx. 18 months ago my fiancé (USC) filed a petition for me to move to the US on a fiancé visa. This was approved and i received a pack from the US Embassy in London with further instructions.

At that time we had a change of heart and elected to have her move over here (UK). All went well, she moved, we got married and now she's been here about 8 months as a resident.

We've now decided we DO want to be in the US and want to file a DCF early in 2014.

My question; do we have to formally withdraw/revoke our previous petition for a fiancé visa (from 2012)? Or will it have expired? Did it become void when we married?

Basically, can we file the DCF as normal or will it be an issue that we should address up front? There used to be a helpful line to call the embassy and speak to a real human but it appears to be long gone (why?!).

Your old petition likely expired or was voided by your marriage if not. When you apply for the new petition via the consulate, there is a field on that where you declare old applications - so you can put that old petition approval in there, and clarify on a continuation sheet the exact situation, if you like. It shouldn't be a problem!

1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath
