my I-130 has been lost

I am a Jan.22nd 2013 filer I called a tier 2 a few weeks back and they told me

my papers had been transferred to the Atlanta field office. I made an infopass

and went there to check on them and the guy asked me how long it had been

since I filed and I told him. He then asked for my receipt number and told me

he would pull my file only to come back 20 minutes later to tell me that they

don't have my file that apparently it has been lost. My question is does anyone

know how to call the NBC so I could call and see if its there. We are in our 9th

month of waiting and it looks like its all been for nothing unless I can locate

where my papers really are because no one at any kind of office seems to

want to help. I also found out if your in the military they don't have to wait

nearly as long as the rest of us in which I find unfair.

You should go to the nearest infopass. you have your noa1 as a receipt. Talk to them to expedite your case on the basis of USCIS error and also get in touch with your congressman to correct this USCIS error (expedited)

I say go in again on another infopass

and ask for the I-130 Adjudication Unit Supervisor.

Then put yer questions to that human.

The clerks you see behind the window know nothing about I-130 adjudication for stand-alone petitions, that's in a totally different part of the building and they ain't connected.

HOWEVER - even with that said - there should have been a barcode scan when the casefile hit the building with the rest of the casefiles - I'm betting that happened (how else would a Tier 2 see that it hit the Atlanta office on any given day?) and it's not lost. It's still in the building, as it's already arrived.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I already tried the congressman and senator both and neither was any help.

I just came from an info pass last week in Atlanta Georgia. The guy told me

to mail him a copy of my wifes I-130 in which I did and he said when he

received it that he would make a decision on it but I have my doubts

about it because of what has happened.

Write one letter explaining saying there is no whereabout your I-130 after 9 months. make a copy of your NOA1 and send one through congressman to USCIS. Then go to infopass and talk to them. Also, you can write to USCIS with the copy of your NOA1. If this is their mistake, they should fix it. Looks like USCIS error to me.

You certainly can. I had called ombudsman yesterday. It was closed because of shutdown but they will make you file the complaint online.

I know the Atlanta office is really behind. There is a thread on VJ for Atlanta you might want to check it out.

Since you were transferred recently they probably hven't logged your file in (thus the reason they have no clue your file is sitting in a mailroom or something). So Sorry.

But I would stay on my congressmans butt and not let up. Make Infopass until someone says they found it.

Is your wife here in the US or still in the Phils.? If she is in the Philippines, then your file should have been processed in Missouri then once approved, they will send it to National Visa Center for visa then from there, they will forward it to the embassy in the Phils. where she will be scheduled for interview. Now if she is here in the states, then they will go to the local field office for processing. Try to call the 800 in your receipt and ask for a Tier 2 officer, don't settle for just the customer service coz' they have all kinds of answer that who knows where it's coming from. You've got to seek help from a lawyer or your congressman if the later was the case. Goodluck...

hi there is not thing you can do trust me speacil with nbc all you need to do right now is to start all over about my case it has been over 13 mounth's and not thing come yet dont waist time for waiting or anything please just you need to apply again as soon as you can bunch people same happen to them is very bad service nbc you have no idea they wont even let you put request or what ever if even they did it tooks years so good luck god bless you

Just want to share with u this a little bit story with regard in USCIS steps I filed last December it took 10 months waiting but on last 7 month ago I am very agitated about my case, in fact I handle three case which is the two who are minors has been approved last june within a week apart but still patiently waiting for my wife case I've tried 3 times to contact them but still got the same answer except the last call I spoken with IO" I was told that my case has been assigned and pre adjudicate. Meanwhile following 2 week since last transaction. I got a letter from local field office. Stating that still in process. Around Last week of September I received a letter again from USCIS statin RFE And must be respond before nov 7 so I wouldn't wait for that date closer hehehe. I called my wife back then have some doc. She mailed me over for 3 days. After I sent back to them I wait just 5 days what A wonderful news for almost 10 months aways..finally

she is in the Philippines and I have talked to a tier 2 several times and they are the

ones who told me it was transferred to Atlanta.
