Renewing your green card when you are not in the US

Hi,

I am posting this for my friend who is a US permanent resident (and an Indian citizen).

His green card expires in June 2014 and he is currently in India. He has an approved re-entry permit valid till July 2015 so he will probably not be returning to the US before that.

Now that his green card expires in June 2014, he needs to apply for the renewal in January 2014. The question is, can you apply for renewal when you are not in the US? Can this be done at a foreign consulate? If not, does he need to visit the US to do his renewal? (do they redo your biometrics when you get your green card renewed?)

I'd have them contact the US embassy or consulate where they are. Just make an appointment and explain the situation. I do believe under the right circumstances that you can renew the GC, and think I have heard of people able to do it with the proper situations (like you said they have a re-entry permit and such). US based job over there would help out or US military service of course I think allow it, but not sure what other circumstances they would allow. Just ask...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

it is a 10 year renewal. The holder is not eligible for naturalization as he has only spent about 2 years out of the 10 in the US and has taken re-entry permits for the rest of the times.

If the friend has spent 8 out of 10 yrs overseas, could be time for him to finally RESIDE in the US - ie. get back to the US before his green card expires in June. Biometrics can only be done in ACS in the US.

If the friend has spent 8 out of 10 yrs overseas, could be time for him to finally RESIDE in the US - ie. get back to the US before his green card expires in June. Biometrics can only be done in ACS in the US.

Moving back to the US before June doesn't quite seem possible as he is a minor and is enrolled in high school. If it helps, he is enrolled in the American embassy school.

Probably. But the point is to get suggestions/solutions/references to any previous cases that were similar.

Suggestion is that he turn in his GC as he is not a LPR of the US. He is a resident of India. What has he done to maintain his residency in the US? Even if you have a re-entry permit, it is not a guarantee that he will be granted re-entry by the CBP. The only saving grace might be that he is minor and thus not responsible for his actions of remaining outside the US. My bet is that when he becomes an adult he will have to remain in the US or he will loose his GC. Since it is a 10 year GC, his LPR status does not expire when the GC expires. He could just let the GC expire and when he wants to return to the US using his re-entry permit, he could go to the local Embassy/.Consulate and get a travel document or temporary GC or at least see if he can get one. That would save him from flying all the way to the US and then be refused entry and have to return to India. The purpose of the GC is for the holder to LIVE in the US, not treat it as a tourist visa for visiting the US.
