We dont have enough money for I-485 and I-130 right now. Can we only file one form?

I am a USC about to marry a Thai national who is in the USA on a B-2 visa that is good for 10 years. She was here last year for two months, left for six months and returned five months ago. Her B-2 runs out in mid-November. We have thought of filing for an extension to give us time to gather all the money we need to get married(the forms etc). We are on a tight budget for medical reasons otherwise we would have the money. We have decided to not file the extension because it seems that everyone gets rejected.

But on the other hand we cannot afford $1500 right now. Can we file only the cheaper of the two forms right now and file the other in a month or so when we have the money? We are going to get married on Monday.

Any reasonable friendly advice would be much appreciated. Thank you.

I believe you HAVE to file concurrently if she is staying in the US and not returning to her home country, sorry.

31/10/2013 Online status changed to RFE response review

12/12/2013 Status changed to Testing and Interview and EAD sent out 10th, AP approved the 5th FINALLY!!!!!

14/12/2013 EAD/AP Combo received in mail smile.png

18/12/2013 Online Interview date of January 23/2014, instructions sent in mail.

23/01/2014 APPROVED...Green Card being sent in mail, no stamp in passport

29/01/2014 Received Welcome Letter

30/01/2014 Green Card Received babayyyyy!!

01/02/2014 Returned Green Card...Mistake on dates

You can file them separately but I wouldn't. It would probably slow things up. Better just to save the money.

About overstay, this isn't Thailand. :) Once you are married to her, you have as long as needed to file the paperwork because overstays are forgiven for spouses of US citizens applying for AOS.

Just take your time, get your money together and file the paperwork.
