Hello friends,

I filed concurrently (I130, 485 and EAD etc) for my wife who is currently under F1 visa on 9/27. I just received the notice for biometrics for 10/29. I know your spouse has to go through counselor processing/interview at local embassy if she/he currently lives in home country. In our case, my wife is here in US. I am bit confused what I am reading online and what legal assistant at my lawyer’s office told me. She said, they will call both of us for interview here at local USCIS office. My questions to you all are,

1. Is it correct?

2. If yes, what is the main purpose so I am prepare?

3. At what stage will that happen? After II30 is approved or before they issue EAD?

4. Can you guys give me tips on what all I should be prepared with? In terms of documents etc. pls. share your experience if you have gone through the interview here in US.

Yes, there will be a joint interview at your local office. That interview will be to decide on both the I-130 and the I-485. Your EAD will get approved on its own, probably before you get a notice for an interview.

so, interview is the next step for us. do you know the typical timeline when this done? My priority date is 9/27/13 and F2A is no longer current (cut off date is 9/08/13 for Nov, 13 bulletin. I wonder, if it depends on whether my priority date is current? Thanks again for your help.

I believe the interview would be to make sure relationship is a bonafide one. Do you and your wife live in Different States? When did you get married? If you live in different states and apply for your wife under F2A you guys might be called for the interview. A friend of mine did the I-130/485 Concurrent application around 10th of September. They did their paperwork through an attorney. They live in different states and was told by the attorneythat they will get an interview to show proof of bona fide relationship.


They have added each other to their Rental lease agreement, added themselves to their bank accounts, opened a joint bank account etc and might ask you questions about where did you meet etc just to see how guys might respond.

we got married on 9/25/13. We live together. you said, "might be" called for an interview. Is it NOT mandatory?

It's mandatory.

Interview can be waved only for kids.

Biometrics ( not to digress from the subject)- how does early walk in works? I may try that.

Once you receive the letter of biometrics, you can go to nearest uscis office and request them that if they can allow you for walk in biometrics.!

You can tell them that you are not able to make it on schedule day.!

So, they might allow to take your biometrics.

You can try it because it not gonna hurt.!!

one more question, my priority date is not current anymore (my PD 9/27/2013 and cutoff date now is 9/08/2013). Would interview notice be sent once my date is current? Or cutoff date is irrelevant to when USCIS schedules for AOS interview?

Yes, ur priority date has to be current then only they can send the interview..!

This is not necessarily true. From what I read from other forums they can proceed to pre-adjudicate your I-485 if they have the time. Only that a GC will eventually be issued when visa numbers become available.

I guess If they are busy, they can choose to ignore processing I-485 for those with Priority date not current.

09/09/2013 - Concurrent filing of I-130/I-485/I-765/I-131 sent via USPS.

09/11/2013 - Delivered to USCIS Chicago Lockbox

09/16/2013 - Acceptance Confirmation text messages (4) and emails (4).

09/17/2013 - Check cashed.

09/23/2013 - Four I-797C notice of action in mail.

09/23/2013 - I-130, I-765 and I-131 online status showing Initial Review. I-485 showing Acceptance.

09/26/2013 - I-797C for Biometrics notice. Appointment scheduled on 10/10

10/01/2013 - I-485 case status updated to RFE and the RFE notice mailed out.

10/08/2013 - RFE response mailed out.

10/10/2013 - I-485 case status changed to "RFE response review"

10/10/2013 - biometrics completed on scheduled date.

10/29/2013 - EAD card production ordered

11/07/2013 - Received combo card.

11/15/2013 - I-485 case status change to "Testing & Interview"

01/02/2014 - Received notice that interview is scheduled for Feb 3.

02/03/2014 - Interview went well. Now it is a waiting game as our dates are not current.

Waiting to receive atleast an I-130 approval

03/17/2014 - Received txt: I-130 approved.

You could be right, however as far as I know, I think your priority date has to be current when your interview is schedule.

Also, someone had an interview before 4 days ago and she did not get approve on the spot because visa officer did not know that her priority date was current or not.

I am sure she will get approved within few days or she might get approved already because her priority date was current.

Still I might be wrong and you could be right..!
