Hi guys!

We entered the US on the 11th and have been spending the last few days just relaxing and letting go of all the stress that comes with visa filing!

Anyway, we are waiting on his SSN and Greencard, but I was wondering if we need to be doing anything else during this time? I don't want him to get in trouble for not being on top of anything...

Also, I read somewhere that he is not eligible for certain things, so is it possible for him to apply for medi-cal?

Or is this frowned upon??

Regular Medi-Cal is medicaid (mean- tested benefit), which the sponsor may be responsible to pay back to the government should the immgrant use it.

Medi-Cal

Medi-Cal is California's Medicaid program. This is a public health insurance program which provides needed health care services for low-income individuals including families with children, seniors, persons with disabilities, foster care, pregnant women, and low income people with specific diseases such as tuberculosis, breast cancer or HIV/AIDS. Medi-Cal is financed equally by the State and federal government.

What insurance can he get, where the sponsor is not responsible for any payments?

It said on the I-864 that she isn't responsible for stuff like this, so it's a bit strange to hear otherwise?

Ok - I'm reading this section of the I864 -

If an intending immigrant becomes a permanent resident in the United States based on a Form I-864 that you have signed, then until your obligations under the Form I-864 terminate, your income and assets may be considered ("deemed") to be available to that person, in determining whether he or she is eligible for certain Federal means-tested public benefits and also for State or local means-tested public benefits, if the State or local government's rules provide for consideration ("deeming”) of your income and assets as available to the person.

This provision does not apply to public benefits specified in section 403© of the Welfare Reform Act such as, but not limited to, emergency Medicaid (ect)

What is "emergency Medicaid?" Does this mean that certain type of medicaid would be OK or no?

Sorry for the panicky tone, but my mother is pretty unhappy about possibly having to pay for this... even though she already knew this was part of the deal dry.png

You and any other sponsor are responsible for repaying any means tested benefits the immigrant uses until the immigrant become a USC one of you dies the immigrant leaves or they work 40 covered quarters. You can buy private insurance for them

emergency medicaid is usually given to mothers that are delivering babies. So if your spouse s pregnant they can do that but it doesn't usually cover pre care

This will not be over quickly. You will not enjoy this.

You can purchase your own insurance privately, through the exchange (not effective until Jan 1, 2014) or through your employer if offered. Of course, you will be paying for it. You cannot obtain medicare (other than for emergencies), food stamps, government funded or assisted housing, and probably some things I forgot to list. These are "means-tested benefits". The whole point of the I-864 is to make sure the intending immigrant doesn't come to the US and start availing themselves of benefits at the US taxpayers expense.

Ok, so the monthly payments that a private plan would incur, would be at OUR expense, not his sponsor's? Correct?

My mother has applied for Obama care including my husband, but if they're telling her she qualifies for medical, he can't be under that?

We just got off the phone with someone from Anthem Blue Cross and he explained that because he's over 26, in the state of California he has to apply with me. My mother is on obamacare, but she thought she could add him.

My mother is not allowed to do ANYTHING for him. Even if she was to do private insurance, she couldn't add him because he's over 26?

We explained to him about the sponsor issue and he said it's irrelevant. Anyone know about this more in depth???

But I think the thing is that the sponsor will become liable for the expenses he may incur, because it's a means-tested benefit. So, whatever he gets for "free", your mum'll get a bill for.
