Italian Married to an American Citizen, Visa inside USA or Outside?

Hello to all,

My name is Dani, and I have been married since three years to an American Citizen. We have lived all this time in Italy, and now we wanto to move to USA. We are wondering which is the best and fastest option to be able to stay in USA and work. Should we apply from Italy, or should we go to USA and apply while being there like a tourist? How long does it will take?

I also have a very and old sick Dad, so if I would be in USA waiting for the Green Card, I want to be able to go to italy if something happen to my Dad, without compromise my Visa.

Do a Direct Consulat Filing (DFC) from Italy for a spousal immigrant visa and automatically get a green card when you get to the US. You would be able to work immediately and be able to travel immediately to see your dad in Italy. This should take about 6 months.

Entering the US on a tourist visa or the VWP with the intent to immigrate is visa fraud. Furthermore, if you successfully enter the US, you would need to file to adjust to get a green card. For 2-3 months, you will not be able to work legally. Also, it will take you 2-3 months to get AP. If you leave the US without AP, you will be stuck outside te US and file a new case and wait a year for a spousal immigrant visa.

What about the sponsor? My wife not working in the USA, cannot sposor me, so we have to ask to her mom. How much income is requested?
