How much of a problem is it if you wait till almost the last day to apply for the AOS?

Her 90 days is up on Dec. 10 and we sent in the AOS Dec. 8

+Nov. 06, 2004.. Meet using Cherry Blossom's

+Nov. 04, 2005.. Go to meet her in person in the home town of Tarlac, City

+Nov. 10, 2005.. Engaged at Baguio City, Philippines

+Dec. 31, 2005.. I-129F sent to Nebreska

+Jan. 10, 2006.. Recieved NOA1

+Feb. 14, 2006.. 2nd visit and suprize for Rowena's B-day wish

+Feb. 19, 2006.. 100 island tour

+Mar. 07, 2006.. NOA2 and wondering what is next to come.

+Mar. 28, 2006.. Recieved letter from NVC

I have seen several post here that they filed the AOS beyond the expiration of the I-94 and didn't have any problems. You filed before so I wouldn't worry about it. Good luck with your AOS :thumbs:

As long as you got married within the 90 days you should be alright, a lot of people wait a lot longer than past 90 days to file AOS! :)

There is no "last day" to apply for adjustment, except perhaps the day one leaves the country without having done it.

Not wanting to steal this thread, but on a similar note:

What happens when AOS forms have been submitted (tomorrow (we married 2 weeks ago)) and AOS isn't granted before my I-94 expires (11 Feb '06)?

- Do I just carry on my life in the US and wait for AOS to be grated? or

- Do I need to apply for a visa extension so that I can stay here? or

- Do I have to leave the US and come back when AOS is granted?

there is no visa extention if you came on a K1 and married its a single entry visa - you are pending status (plainly out of status) until AOS is approved.

leaving the US is not at all what should be done unless its simply for a visit and you have your AP document OR you want to leave and refile for a K3 or CR1.

Many thanks for the info - that is pretty much what I was hoping and thinking. My US driving license is only valid until my I-94 expires, what do I do when this happens? I'm not insured if driving on my UK license.

It is recommended that you file for AOS as soon as possible. If you have completed the requirement to marry within 90 days, that is the first step. Filing for permanent status changes what you are doing with regard to status in the United States. You are technically out of status once the I-94 expires, but having filed for AOS it the next step.

If you leave the country, even for a short visit, you will not be allowed back in unless you have received your green card or you have also received Advanced Parole (AP) from the USCIS. The processing of the AP is almost as long as the AOS. So don't leave unless you have AP or completed AOS with green card issued.

If you drive, your international driving license should be adequate until your status has been established as permanent. Start reading the driving laws of your state to prepare for obtaining a driver's license here.

Yes, they looked at my I-94 and saw that my visa was only valid for 3 months so I only got a license for 3 months. I guess I need to revisit them and say I should have a license for longer. What can I show them to do this?

It may not be possible to renew or extend it, it all depends on your state DMV, some states require a greencard to obtain a license. Sounds like your state is more lenient though. Perhaps post in the Moving to America Forum to see what other VA'ers dhave done or look up your local DMV and their requirements.
