Needs an I-797 to get a state ID???

I just got back from the BMV after the past month and a half of them screwing us around.

This past time we got a letter in the mail that said that our documents expired and that's why they didn't issue her her temporary state ID.

I went in today and they said that we have to have an I-797. An I-797 is just a Notice of Action. What notice of Action do they need?

I called the USCIS and they told me that the NOA2 would work, but that expired back in 8.25.2013. So I seriously doubt that the NOA2 would be accepted when it's expired when they wouldn't issue her an ID because her I-94 expired a week from when we tried to get it.

Has anyone else experienced this situation?

What do I have to have in order to get my wife a state issued ID?

We haven't been able to get her SSN updated because of the shutdown, does this have anything to do with it?

Also, I doubt we need the I-797 from the AOS because for the AOS we need proof of a bonafide relationship ie. her on the lease, her on my bank account etc etc. We can't get her on any of those without a State ID.

So please help me figure out how I'm supposed to get her a State Issued ID.

09/25/12 - Saw on USPS that the package was delivered in Texas
09/28/12 - NOA1
10/08/12 - Received hard copy NOA1
12/19/12 - CFO Counseling Session (to get it out of the way)
04/27/13 - NOA2
05/06/13 - NVC Received and MNL # assigned
05/21/13 - Medical Exam Day
06/04/13 - Interview Day
xx/xx/xx - Visa Arrived
xx/xx/xx - Off to Chicago

You will probably need EAD to get an ID. This is very common. Check for the regulations in your state's policies; some need GC to get an ID.

Also, AOS from a K-1 doesn't require any proof of a bona fide marriage. Also, you don't need state iD to get on bank accounts or leases. Use the passport and SSN.

Well I figured when the Bank and the Apartment says that she needs a state issued ID to get on those things, that she probably does.

What form do you have to fill out for EAD? Is that included in the AOS or can you file is separately?

EAD goes with AOS.

The bank is wrong. No one is required to have a state ID. Use her passport for ID.

If you want to believe they are correct when they are not, then I don't know what to say.
