Hello,

My fiancee's K1 is approved. She's packing for the US :)

Do we have to pay the USCIS Immigrant fee of $165 using ELIS before she departs for the US?

Thanks!

To my knowledge this is a a fee k1 visa does not have to pay, I belive its for regular immigrate visas. Other with more expiernce here can confimr or deny this. And, I also belive once you go to AOS and go to get your green card is when you would have to pay thins fee.

K1's are exempt from the fee. You do not pay this fee for AOS either, BUT you do pay for AOS per se of course (currently $1070.00).

The answer is in your question. K-1 is a non-immigrant visa.

The answer is in your question. K-1 is a non-immigrant visa.

I think the confusion for many people is that the K1 is a non-immigrant visa, but processed like an immigrant visa.

I think another issue is they see a notice on the embassy website and instantly think it includes them without reading the whole page.
