AOS???

Hello All,

My fiance came to the US on September 6th based on a K1 visa. How long do we have until we submit his AOS application. Any help would be greatly appreciated!

Well you will have to marry him before his 90 days expire (before December 5th) .

Once married you can apply for AOS as soon as you are ready.

Thanks for the reply. We already got married, but we need some time to get the money and all paperwork to submit the application. I wanted to know if there is a time limit t apply as their is to get married?

You technically do not have a deadline. But it's better to do it as soon as possible as your husband will be out of status after Dec 5.

No, there is no deadline to file for AOS. If you married within the 90 days, then you are eligible to file for AOS. You will be out of status when your I-94 expires, but there is no requirement to file for AOS within those 90 days. Lots of people file a couple weeks or months after their I-94 has expired, and they have no problems. Just stay away from border areas and CBP checkpoints while your I-94 is expired. Once you file for AOS, you will be a new period of authorized stay.
