hi everyone,

So, I am a USC who filed for both my mom and dad last month. I have a 19 years old brother, turning 20 next year of April.
Although I know the law says unmarried underage child cant go, to make this story short, my girl friend, whose parents just arrive here in the US couple of months ago say, during her mom's interview with the US Embassy back in Manila, the officer ask her why didnt they put her why they didnt put the unmarried underage son onto the I-864 were he could have join her to go to america. My friend keep on insisting that this is something new that nobody know! and she said that I should put my unmarried underage brother's name when Im ready to submit the I-864.

so, is this really a new law?

I really hope to see alot of comments pls? :-|
I will really appreciate it.

your brother needs his own petition. If you petition him it will take over 12 years for a visa. ( sibling petitions maritial status doesn't make a difference ) if one of your parents petition after they arrive it will be very dependant on if the process moves fast enough so he doesn't age out of being a child.

This will not be over quickly. You will not enjoy this.

For sibling petition, more than 20 in this case, OP is from Philippines.

OP, have one of the parents file for unmarried child as soon as they make it to the US. If he ages out, wait time currently for F2B is around 10 years for Philippine beneficiaries.

Were they petitioned for by a sibling?

Different cases different rules.

It could just be a simple misunderstanding.

Bottom line is, your brother will not immigrate as your mom's derivative. He doesn't count on the i864 because no petition was filed for him.
