Hey, here is the story. We got married before the I94 expired, we have applied for AOS. But technically she is out of status and insurance carriers will not write a policy for her. What are our options? It will be months before she has a temporary green card, which is what the underwriters want to see.

Her immigration status (which is legal, btw, since you have I-485 pending) should not be a part of insurance questions. What have they asked from you?

More important than that, did she get a SSN? They will ask for that.

Yup got the SSN right after she got here. Sounds like that is a stumbling point for a few people right now.


Filing for AOS puts her in a period of authorized stay. She has applied for permanent resident status, not temporary.

So, the 797 should be proof of legal status then?

That is weird that they are asking for immigrant status then. I was able to add my wife the next day after we were married to my insurance, she got her card in the mail two weeks after that.

Unfortunately, we went through something similar. We couldn't apply for a state ID until she had the green card, the 797 meant nothing to them. Once we got the EAD/AP card, we went back to the DMV, and she was able to get an ID, albeit with a temporary resident stamp in big red letters.

Maybe that's what you may have to wait for.

Well, she only had to wait 2 months, because once she got the EAD/AP card, we were able to get the ball rolling. If she has that card, it is proof that she is here legally. Perhaps the insurance carriers will be satisfied with that. It's worth a shot.

Here's hoping you did apply for the EAD and AP concurrently with the I-485.

Have you tried your States obama care? I know for mn it is mnsure but I'm not sure what it is for wi. Give them a try. Only thing I think they take effect at the start of 2014.

AOS Journey

11-04-2011 sent AOS to Chicago lockbox

11-07-2011 delivered

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!
