Hi,

I am a naturalized citizen. I got my green card in 2008. Then me and ex wife divorced. I obtained my citizenship in 2011 based on 5 yrs

rule.

I have a girlfriend now and I want to marry her. She entered legally the US as housemaid with a Visa in 2001. I think the visa expired

in 2003. So she is been living illegally here for 9 years.

She lost her passport with the original Visa and the I-94 stamp. (her boss and her had an argument over low pay salary and

very long working hours; her boss, -who was keeping her passport- claims she lost her passport)

How do we show the immigration she entered legally?

Since I am naturalized citizen, Will somehow get in trouble by marry an illegal alien overstaying for so many years?

pls advice

You will not get in trouble for marrying her.

She must contact the consulate of her home country, report her lost passport and apply for a new one. She will need a valid passport if you are planning to apply for her GC based on marriage and she will not get one until she wither presents the 'lost' passport or reports it lost.

Hi,

on my previous post I wrote about me (US Citizen ) and my girlfriend (lost passport with original visa) want to get married.

We must request a copy of I-94 and a copy of original visa (issued back on 2001 ).

Will a request of I-94 for someone overstayed for over 9 years to Uscis risky? What are they going to think?

Should we marry first and then request it? I mean I don't want to send a request and have agents come in

and deport my girlfriend

pls advice

Hi,

The USCIS will not think anything about requesting an old I-94. People do it all the time for different reasons. Unless you can prove she entered the country with a visa she will not be allowed to do AOS stateside, and the only way to prove she entered legally is with a copy of the I-94.

The USCIS will not think anything about requesting an old I-94. People do it all the time for different reasons. Unless you can prove she entered the country with a visa she will not be allowed to do AOS stateside, and the only way to prove she entered legally is with a copy of the I-94.

It doesn't matter. You will need the I-94 only when she starts her AOS process, which means you can get married at any point you wish. Bear in mind however that she will not become legal just by marrying you, so the sooner you get married, the sooner she will be able to start her AOS and the better off you are.

You can order a replacement I-94, for a fee. I have never heard of a visa for a maid.

Maybe it is a work visa?

Never heard of one for a maid. Generally you have to prove there is no USC that can do the job. Plenty of USCs can be maids.

It doesn't say she got a visa for being a maid, though. Maybe she was already in the US.

I just worry the OP's gf is lying about how she entered the US.

I just looked it up and apparently you can get a B-1 or a diplomatic worker visa to be a maid temporarily, like if a diplomat was coming to the US for a while and was used to having servants.
