In general he can, but would have to submit petition / labor certification (typically done - as you've been told multiple times) by lawyer and prove no US based workers are available to perform this work. EB-3 also has at least 3 years wait at this point. Finally, there will be substantial cost on his side to do it.

Why would the US let you in to work when the job can go to a unemployed US person? The US government does not simplyly let foreign workers take jobs that can go to unemployed people here.

The exception is for the business's lawyer to file and get a Department of Labor certification that your uncle could not find a qualified person to do the job and therefore needs a foreign worker.

Is there a reason your uncle can not hire a US person to work in his convenience store?

wait - what happened to the plan of going to a 2 year community college? FWIW, that seemed to hold the most merit, of all your paths to be inside the USA.

EB 3 is probably the most practical.
