Filing for my Wife adjustment to GC

So let me give you a background:

I have known my wife since we were kids back in Indonesia. Well I moved down to Texas with my parents when I was in middle school and we didn't get in contact again till 2010.

Talked a lot to each other, she was going to college at University of Florida and graduated 2011 for Electrical Engineering.

We started dating at March 14 2011 and started living together after her graduation which was in December 2011.

She applied for her OPT status before hand.

My wife and I got married 10/16/2012

She is now on OPT Extension Expires June 2013

We are now gathering all the documents for her GC application. Which is the I-130, (2)G325a, I-485 w/ I-765, and I-693

I am currently A student half-time Fall 2013 and full time Spring 2014 (Unemployed but still searching for part time work here in California). She is working making over 50k/year as a Engineer.

Questions:

1. I was told that I could send all the papers at the same time since she is already here in the US living together, is this true?

2. What kind of proof exactly do I need to send for them to see it as legitimate marriage?

2a.She is an authorized person on my credit card and so am I on her Bank of America CC. (I am having trouble getting a bank account since lol its a long story.) (but I do deposit my paychecks into her account)

2b. We have plenty of photos together.

2c. She on my car insurance which she drives the car to work everyday.

2d. I have marriage certificate.

3. Can I just send my Certificate of Naturalization to show proof that I'm a US Citizen or do I need to get a US passport and send it too? (they didn't let us register for passport at the Ceremony and got busy afterwards.)

4. On the Petition we would file it joint? since we are married and living together right. Which looks at the overall household income, which is above the 19k/year for two I think the website says for the poverty line.

4A. Is that good enough or do I need someone else like my step-father(me mom and stepfather lives in Texas) to petition with me?

5. Am I missing anything else?? I really want to make this process go smoothly because these kind of stuff makes me stress out and overthink.

Thanks Everyone for your Advice and help on my Naturalization which I got approved March 2013!!(I was ridiculously stressed lol).

And Thank you ahead of time for everyone that helps me through another Visa Journey together and hope by this experience I can also give a helping hand to other couples that will go thru this process.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I also recommend I-131 for advance parole. Also, many of the forms will require their own supporting forms. e.g. I-485 will require I-864 affidavit of support, and also another G-325a. Also, it is recommended to put a G-1145 at the front of everyting, for notification.

Yes, you should send them all in the same envelope.

This sounds good. If you guys have any joint rental leases or ownership of property that would be good too.

yes

You are the main sponsor. Her (the intending immigrant's) income can be counted without filing any separate forms. There is a box on the I-864 to check that you are including the intending immigrant's income.

5. Am I missing anything else?? I really want to make this process go smoothly because these kind of stuff makes me stress out and overthink.

When you have everything you can post a checklist and ask people what they think.

What is the i-131 for? She is already in the US legally and we have no plans to travel anywhere.

The advance parole is for if something unexpected happens and she needs to leave the country. There is nothing to lose by applying for it.

oh ok. I talked to her and she said it's not worth doing since she has no reason to leave the country at all.

ok Now i got an RFE:

" For the household member's income to be included in the household income, the household member's income must have been from a lawful source and earned while the household member was authorized to work in the United States."

" Please submit evidence that the household member of Form i-864, Affidavit of Support, or Form i-864a Contract between sponsor and household member, was authorized to work in the United States."

-- on the initial papers sent, i included my wifes EAD card from her stem opt extension she is under right now. Should i resend it again and maybe include the previous Opt EAD card to show that she was legal to work in the united states for our taxes in 2012 and 2013?

I will mail out the copy of her previous and current AED cards along with the RFE letter tomorrow. Hope that's all they need.

Yeah USCIS sometime misplace what you sent so if they request for it, simply sent it in order to not delay adjudication of your case.

Yes I guess they did.

I sent it on 4/1st/14 and they received it on the 4/3rd/14. Status updated to review of rfe on the 4/4th/14 and case changed to testing and interview on the 4/7/14

Good News. She got accepted for her EAD after i sent in the RFE. We had our interview on July 18th 2014, and got accepted on the same day for a 2 year conditional Green card since we are married for less than two years. The interview process took over an hour, we went through all the paperwork. We didn't have a joint bank account or our car in both our names. All IO asked us is how we met, so we told her our story and there was silence after that, writing, typing on the computer, and about 20 minutes later (the computer had issues) she goes out to the printer outside the office and grabbed some papers, then she sat back down and told us to get a joint bank account because it is important and said she was accepting our application for a conditional green card because of our marriage is under two years.

I was a suspenseful day. We didn't use any lawyers but almost all the couples that morning we were there had lawyers. Some of them was questioned for fraud, forgot what they called that test, and some got denied. So really as long as your marriage is honest and real, there is really nothing to worry about.
