Hello, I am preparing to file for my wife who is in Egypt. we got married a month ago but have been engaged for about a year. I am in loss and don't know how to file for the CR-1. Answering any of the following questions is much appreciated:

  1. What form do I use? Where can I find it?
  2. When do I file it? with the I-130? or after I receive the NOA 1 for the I-130? or after the approval of the I-130?
  3. Where do I submit the application for the CR-1?
  4. Is it just the form or it is package?
  5. Is it true that if I file K-3 visa it will change automatically to CR-1?

many more questions but if I get answered for this it would be great for now

Oh wow! Those are all such loaded questions.....you have A LOT to read and study my friend. Please do that before you take another step. You need to make sure you understand all of this and the forms and their purpose and the documentation that has to go with them and all of the "what happens next's".

note....typical turn around time for the I-130 is 8-12mths.....typical turn around time for the I-129F is (maybe/maybe not) 5-10mths.

Go up to the guides on VJ also and read up on the CR1/ The K3 is really a dead issue. It will not get you anywhere and could possible slow down your whole process. Once you file a I-129F after a I-130 it also gets sent to the same NBC center and if it gets to NVC first they administratively close the petition and you go the IR1/CR1.

If by chance they do let a K3 through that is what you come to the US with a K3 Visa. But that won't happen.

Go up to the guides on VJ also and read up on the CR1/ The K3 is really a dead issue. It will not get you anywhere and could possible slow down your whole process. Once you file a I-129F after a I-130 it also gets sent to the same NBC center and if it gets to NVC first they administratively close the petition and you go the IR1/CR1.

If by chance they do let a K3 through that is what you come to the US with a K3 Visa. But that won't happen.

Thank you for your help. However, this did not answer any of my questions. Also, I am considering the K-3 and I read that it might delay the process instead of expediting it.

1. I-130 form. You can find it here http://www.uscis.gov/files/form/i-130.pdf

2. You file it together with : two G-325a forms http://www.uscis.gov/files/form/g-325a.pdf (one for you, one for your wife, with original signatures), 2 passport style photos each, photocopies of: your marriage certificate, your birth certificates, bonafide marriage evidence (leases, bank accounts, photos together, call and chat logs etc etc)

4. Like I said above, it is not just the form. There is a whole bunch of stuff you need to submit.

9/6/2013 -Priority Date 5/13 /2014- Case number and IIN assigned

2/25/2014 -Transferred to NSC 5/20/2014- DS-261 completed

3/31/2014 -Approved 5/21/2014- AOS fee invoiced and paid

5/22/2014- AOS package overnighted to NVC

5/28/2014- AOS scanned into the system

6/20/2014- IV invoice email (but fee still locked on CEAC )

6/23/2014- IV fee finally unlocked and paid.

IV package overnighted to NVC

6/30/2014- IV scanned in. DS260 completed.

7/1/2014- AOS accepted

7/2/2014- False checklist (AOS reviewed)

8/1/2014 False checklist (attorney's G28 reviewed)

8/2/2014 False checklist (NVC not sure why it was generated)

I am the beneficiary. 8/12/2014 CASE COMPLETE!
