Temporary Job!Will this be an issue?

We filed our I129F packet in August, 2 weeks after that my fiance' moved to a new company. His job description as of the moment is "temporary". Is this going to be an issue during the interview? On our I129f we mentioned his old company since he's still working there and we also used it on our affidavit of support which was included in our packet. We received the approval of our petition on September 27. We are awaiting for our case number to schedule my interview.

We're going to update/ bring a new affidavit of support for the interview which is his new company. I am just worried that we'll have a problem with this since he's not employed "full time". His annual salary is above the poverty guideline, 125%. But the job description on the employment certificate will be "temporary".

I need your help guys. Being away from someone you truly love is difficult. I want to be with him soon.

Your advice will be highly appreciated:)

God bless everyone!

If it is not a permanent job then he will not qualify to be a sponsor. Not sure why you included financials with the petition; it is not required at that stage.

AOS for my husband

I have two jobs, both part time. Don't make enough, apparently.. so my boyfriend was refused of the visa. The CO didn't take the co-sponsorship either.. but it apparently depends on the leniency of the CO if they will review your co-sponsor or whatnot. Good luck!!!

On October 2013, our I-129F Refused under 221(g)

So our son and I went back home to the PHL..

I am having sleepless nights because of this. Right now, I have decided to wait until he gets hired full time before I schedule my interview.

Thanks guys for replying.

God knows what He's doing. I surrender everything to Him.

Any chance one of his parents can be a Co-Sponsor, as a backup? I know they might not accept a Co-Sponsor, but it can't hurt to bring the forms just in case.

But yeah I think it's probably a good idea to try to make it a permanent position before doing the interview if possible. Is there any chance you Fiance can talk to his boss about this? Or could he resume his old job maybe?

Keep in mind that (I think) you need to have the visa approved within 4 months of Noa2, meaning you need to have it done by about the second half of January 2014. That might be enough time for your Fiance to find a full time job.

Our petition will expire on January 26, 2014. I am going crazy thinking about this. My fiance likes the new company and he's hoping to be full time first of December. Yet he also told me that there's going to be a temporary company shut down in December. I am not exactly sure what that means but he said that he'll either get hired full time December or January. I am honestly exhausted about the whole process but I believe that God is in total control of everything. Maybe He's asking us to wait for His perfect timing.

Thanks everyone for replying:)

Maybe he could ask his boss for a favor? I mean, if it's a big corp that he's working for, it'll be hard to ask for that, but just to have it on paper that he works full time, then you'll be set since he makes enough money.

This is what I'm thinking too. I'll talk to him later after his work. I don't know if this is possible since he's only been there for almost a month and it's a big company. Thanks for the idea:)

Well, on my other part time job, I'm a server, but it is under a corp too. I explained to the owner that my boyfriend was refused of the visa and we need more documentation that I make enough, then she wrote this letter saying that I make such and such annually not including the tips. Ask him to approach them nicely, it doesn't hurt to try, right? 'cause if he still not permanent/full time on his job by January and your case expires, then what, right? So ask him to try. I'm sure you guys will get thru this. Good thing he's not a gov't employee and on furlough.

It doesn't matter if the job is part time or full time as long as the income is sufficient. If the job is described as temporary that could be a problem.

I see you believe this is all part of some gods plan. If that's what you believe I don't understand why you would spend one second worrying your way thru this at all. If your god approves of this then you will have what that god wants you to have. It seems USCIS isn't even part of the problem even though they must approve the case. I don't see why you would lose sleep either. Sleep well as you await the days and nights ahead and understand you are simply part of that " perfect timing ".

Full time work is full time work, a lot of people work many different jobs. I would just tell them he is full time employee at interview, but they probably won't ask. My fiance wasn't asked a thing about my work or employment. The interview is very simple, just stay positive and bring lots of info with you just in case. I think the key is to push that your fiance is a hard worker and will find a job and always have, it will help if you can support that with evidence. Just stay positive and keep moving forward.

I agree with Pamela Lycos. At the time of Juliet's interview I am unemployed essentially earning zero though I do collect some unemployment benefits--but these are disregarded. I've been unemployed for 8 months.

At the interview earnings and being unemployed was simply not discussed. We did get a 221g but for divorce documents.

But my 2012 1040 is well over double required, and I did include a summary of assets, though we don't think that they were really considered.

Therefore if his last year 1040 is above the minimum, I suspect, temporary or not, that you're ok.

His last years annual income was above the poverty guideline. He left the old company in August and started working in his new company in September because the pay is higher and there's an opportunity of being hired full time. But of course we don't know when this is going to happen and our petition's expiring in January.

Thank you for sharing your experiences. Thanks everyone for being so kind and helpful. Thank you for giving me peace of mind.

God bless everyone:)
