Judge throws woman & 2 kids in jail for refusing to testify against husband

website is devoted to abuses by law enforcement. not like any of that ever goes on, eh?

A judge holding a witness in contempt for refusing to testify is NOT an abuse by law enforcement.

And rest assured, the US is NOT a police state. Any claim that it is is a sign of paranoia and nothing else.

Correct - Although there are those which will argue otherwise - (presently) The US is NOT a police state in the rigid sense of the definition. (but) "Police State" has become a (I'm struggling with a way to state it but perhaps) metaphorical euphemism..?.. . "Police State" is being used as a pointer indicating a (potential) direction this country is heading.

This article may or may not be myopic / biased but it still presents a procedure = forced / coerced / incented ...whatever you want to call it - family members were being forced to testify against dad & that might or should draw concern for ...what's next? I can see the rationale of protecting the family from Dad because they lack the courage to do what's best but....what's next?

Call me old fashioned but the criminal ceased to be husband and father when he beat his wife and children in a brutal and life endangering manner. He committed a number of felony offenses and he must answer for those. Thejudge more likely than not saved lives.

I agree but do you think the 13 year old will see it that way? Perhaps the child should've been sat out this round.....

Well kids don't know what is best for them that is why there are these creatures called grown ups that were created to take care of them. If boxing matches with her dad don't help her and her mom doesn't either then it is the judges responsibility as the apparent only real adult in the situation to help out.

Abused family members often do not see it that way. Which is why they are trapped in the abusive households and continue to be victimized by their abusers. The law enforcement and justice system has an obligation to help these victims out of their predicament. And that is exactly what this judge has done. To sit there and scream "police state" over this is not just nonsense, it's utterly insane.

Your argument validates mine = the 13 year old should have been spared the additional trauma. There are other & more appropriate ways to garner testimony out of a child. The judge had 2 other witnesses = more than enough.

Abused family members often do not see it that way. Which is why they are trapped in the abusive households and continue to be victimized by their abusers. The law enforcement and justice system has an obligation to help these victims out of their predicament. And that is exactly what this judge has done. To sit there and scream "police state" over this is not just nonsense, it's utterly insane.

There should be reasonable restrictions to prevent abuse of power. Tossing Mom and 17 year old son behind bars...circumstances probably justify it but...Incarcerating the 13 year old is extreme. That is too tender an age to be handled so rough. You think throwing the police state euphemism at this judge is "utterly insane"...please offer another...how would you sum up his abuse of power?

There's no abuse of power. What is rough on these children and their mother is their violently abusive husband and father. That is the predicament that they needed help to escape. That's not hard to understand. Again, abused spouses and children are often very protective of their abuser. And many times, they will protect them until their abuser turns into their killer. There's nothing extreme about saving the lives of the mother and her children. It's what we should expect from our criminal justice system.

Handled roughly is what the dad did, not the judge.

To tender for the judge to give her quiet think time but not too tender to get beat by daddy?

In some kind of irony, while Joel Darvell was released on bail, his family was arrested and put in jail.

Both minors were taken to a juvenile detention center, where they were held in cuffs and shackles. They were separated from their mother and treated like criminals.

1) Dad did much more than handle her roughly. Dad traumatized the kid. Psychological scars last much longer.

2) (smh) Ludicrous. The kid was made a victim by both. Duh.

You are amazingly wiling to embrace authority.

Locking up a 13 year old was the act of exasperation. There are other ways to garner testimony. The Judge's behavior (regarding the 13 year old) was extreme. Mom would have been sufficient & appropriate. Knowing mom was locked up would have encouraged the kids to come to her aid. That would have given them an out for testifying against dad. The judge is a reckless 36 year old hell bent on getting his way in his kingdom (aka court room).
