Judge throws woman & 2 kids in jail for refusing to testify against husband

The victims were witnesses who were found to be in contempt of the court. That earns you a visit to the judicial facilities. That wife beater of a husband and father belongs behind bars. Period. He should not be roaming the streets and he should not be given the opportunity to further injure or even kill his wife and children. The latter is precisely what was bound to happen had the judge not done what he did.

Prosecutors moved forward with a trial, but Darvell’s wife and children — a 17-year-old son and a 13-year-old daughter — all refused to testify.

Cowlitz County Superior Court Judge Michael Evans did not respect their decision to remain silent. All 3 alleged victims were dragged away by deputies after the judge held them in contempt of court.

Lots of mistake going on here.

The judge didn't respect their decision to remain silent and not provide testimony. The judge forced the spouse and kids to testify against her husband.

Unfortunately, this probably will wind up in appeals.

Sorry, they can be held in contempt of court. This is done all the time.

Dragged off are words the news used, more like they were escorted.

It wasn't under duress, or "encouraged," the judge gave them quiet time in a nice and quiet place for them to think about their lives and futures because if they went back home they would have none!

I'm sure they were in a holding cell, not with murderers, rapist, molesters and predators.

Bubba didn't get none of that fresh meat.

no they weren't even escorted off. more like stomped out of the courtroom with the court officers following.

After 48 hours of imprisonment, the 13-year-old girl was brought into court wearing shackles around her ankles, handcuffs, and sweats issued at the detention center. The judge had broken her will and she agreed to testify against her father.

The judge compelled them to testify. That's within the rights of the judge. And it was a good call that may very well have saved their lives.

that he may have done. it may also have opened an oppotunity for appeal which nobody wants.

didn't the video indicate that only a protective order (piece of paper) keeps the guy away from his family until trial?

If you are confined to a detention for a certain amount of time, you are made to shower and dress out. Or they could have always let her daddy bail her out, right?

At least they gave her fresh clothes instead of letting her sit around in a stinky body.

Good Lord, consider the source of the information. Read real news reports rather than some wife beater cheering blog about it and all of a sudden you will see that the judge isn't some tyrant or animal. The husband and father, on the other hand, most certainly is.

Judge Evans said in court Thursday that he would allow the girl’s mother to see her in detention.

“I recognize (she) is 13-years-old, and I don’t have any problems with her mom visiting her tonight,” he said.

don't have the time some people have to surf lots of sites during the day. I simply read the OP/ link and commented.

Per your link, the judge is a nice guy and didn't intimidate a 13 yr old girl.

Wednesday during court, judge ordered the 13 yr old girl into the custody of the court and seperated from her mom (different detention facility and all victims seperated)

Thursday, seperation from mom during court. Decided to allow mom visitation later that day during court.

So a 24 hr time-out away from mom and brother.

That could be a good thing. Send her off to "camp" to get her out of harms way and away from all family.

The boy and girl spent Wednesday night in the Cowlitz County Juvenile Center, and their mother was held in the Cowlitz County Jail.

The girl was not in court Thursday because, according to Hanify, her attorney, she showed no sign of relenting. But, later in the evening, Hanify said the girl had agreed to testify and would likely tell Judge Evans as much at a hearing today. The girl was expected to spend Thursday night in the detention center.

Judge Evans said in court Thursday that he would allow the girl’s mother to see her in detention.

“I recognize (she) is 13-years-old, and I don’t have any problems with her mom visiting her tonight,” he said.

By Thursday evening, after more than 24 hours behind bars, all three relented and agreed to take the witness stand at a future date.

the point remains the same as that in the op - why are people being jailed to force testimony?

Yes, when the outrage is directed at the judge that follows the law to compel witnesses to testify in the trial of a criminal but not at the atrocity of the crimes committed.

And the website could have done with a bit less pathetic a name. When one puts up or frequents a ridiculous website, one should expect to be ridiculed.

website is devoted to abuses by law enforcement. not like any of that ever goes on, eh?
