Hi All

Thank you to all for providing thi forum. iam hoping some of the seniors memebs can assist me figuring out what to do.

Our I130 is approved and it was send to NVC..A letter from NVC was received with case numbers and so forth.

Problem is that we need to do AOS since she is in U.S. the visa is current and its ready to go. However the letter from NVc says do not o anything until they are informed I did email them saying we would like to do AOS but still no response.

My question: Can i still send the AOS package to uscis before hearing from NVC? witout facing delays and issues.

when filing the AOS SET, include a photocopy of the I-130 approval notice, formletter I-797C, NOA2.

That's it, that's all that has to happen.

USCIS will retrieve the file from NVC, eventually, but it won't stop any processing, as there's an electronic image of the I-130 casefile already stored with USCIS.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

~ Moved from AOS from Family Based Visas to AOS from Work, Student & Tourist Visas- OP filed an I-130, so assuming this is not an adjustment from a K visa ~

I helped a friend do just this when her I-130 was accidentally processed as being out of the country. Send in the AOS, include the approval notice and on the cover sheet state what you are doing. She also emailed the NVC with what she was doing.

I would send the AOS package and they have options for you to say whether your in the US or not.Check your in the US and send the NOA for the 1-130 together with the package so that they know it is approved

10.15.13 Successful walk in biometric appointment

10.31.13 I485 Status changed to testing and interview while all the rest are still at initial review

11.27.13 (day 56) I-131 approved and on post decision activity while EAD is on card production #confused

12.06.13 the EAD/AP card combo arrived and was sent to my home country via DHL.I LEFT WITHOUT IT !!and i arrived in the US just fine dancin5hr.gif

01.27.14 Interview date in Oakland park,FL

02/10/14 Green Card Received
