Unusual situation. Advice sought.

Someone I know came to US on 3 month h2b visa. He overstayed and got married to us citizen in spring 2011. He started filing for I130 as relative living in the United States. Initial petition received NOA but he never adjusted status. He separated from wife spring 2013 after 2 years marriage. They have not yet divorced. Any ideas of what steps can he take now to become documented?

He could self petition if he suffered mental abuse or if he was victim of domestic violence, but considering what you said he was not victim of domestic violence or suffered mental cruelty.

Trying to create claims to stay in the US will get the petition denied and earn the person a lifetime ban for fraud. You should advise someone to play foolish games just because you wouldn't suffer any harm

Creating fake vawa reports is a crime and should not only expell the reporter but those that are aiding them in defaming a USC. I am glad you post this kind of stuff on a site that immigration watches so they will know who you are.
