Someone I know came to US on 3 month h2b visa. He overstayed and got married to us citizen in spring 2011. He started filing for I130 as relative living in the United States. Initial petition received NOA but he never adjusted status. He separated from wife spring 2013 after 2 years marriage. They have not yet divorced. Any ideas of what steps can he take now to become documented?

Sorry, without a USCitizen being the petitioner and sponser, for a family-based adjustment of status,

he's no path 'to become documented'.

He needs to speak with a immigration lawyer and see what options he has. There maybe other factors to his marriage that make make him qualify to even self petition. You can pm me.

08/2012 Discussed my immigration issues with a lawyer

08/2012 Started gathering evidence

11/2012 Paid my deposit (forgot to sign documents)

01/2013 Signed documents

02/19/2013 Vsc received my application

02/22/2013 NOA mailed out

My lawyer has a prima facie never collected it Caz I don't need any benefit at this time.

03/05/2013 EAD mailed out (actual ead date, it will expire 03/04/2014)

03/08/2013 Lawyer received biometrics for 3/17/2013 (day after my edd, [expected due date] did early walking 3/12/13)

03/29/2013 Card in hand (lawyer received it abt a week earlier but I delivered so was unable to collect it)

Waiting for my i360 approval but I'm in no rush (good things come to those who wait)

8/14/13 i360 approved. :)

10/8/2013 aos interview. .. approved :)

10/9/2013 status adjust to lpr and welcome package mailed out.

8/15/2013 I484 transfered to local office. :)

Trying to create claims to stay in the US will get the petition denied and earn the person a lifetime ban for fraud. You should advise someone to play foolish games just because you wouldn't suffer any harm

This will not be over quickly. You will not enjoy this.

If u read with understanding u would not reply quoting something with an answer that has no relevance to the quote. Thank you. I said "you may" not "you have"! People don't always know their options so sometimes you need referral that's why I suggest that he speak to a immigration lawyer and not take some "incompetent" person's advise. Yes I know a attorney that assist me that I can refer him to. I didn't suggest a route or path for him to aos. Next time pls just read without judgement and not imply base on your feelings towards a aos route that was passed by UNITED STATES, not by another country or by one person. If you have a personal feelings towards i360, report it to congress, uscis and not bash ppl. I've seen several of your comments on here. That is why I don't ask for information on here I seek professional help. Thank you!

Creating fake vawa reports is a crime and should not only expell the reporter but those that are aiding them in defaming a USC. I am glad you post this kind of stuff on a site that immigration watches so they will know who you are.

This will not be over quickly. You will not enjoy this.

Up this this point I never suggested a route for him to take in his aos. But because your so anti vawa that's this first thibg that cane to your mind. I'm happy io are educated ppl that read with understanding and not make assumption like naive ppl. The mind is a terrible thing to waste! Read before you write and if you don't understand read again. I never told him to choose vawa or maje a false claim. I suggest he see a lawyer! He has the right to. Did he tell you heplans to ffalsely claim vawa? He never even explain what cased the breakdown of his marriage so when he explain everything to a "competent professional" then he decide if he can aos or go home! America is a no man land who are you to tell someone to go home? A lot oh ppl were and is still here that contribute more to this country than its own ppl. Now leave me alone and attack someone else who don't know their rights! "Knowledge is powere"
