Montreal and NVC Questions

Hi,

Our i-130 has not been approved yet (6 months and counting) so I am using this time to familiarize myself with the NVC process. When we started down this road we were overwhelmed with a lot that was going in our lives and chose to use an attorney to help us. Honestly, I have nothing bad to say about him or the services he has provided so far but I want to be sure that using him will not slow us down once we get our i-130 and move on to the next step since we are already 6 plus months waiting.

So here are a few question I am hoping you can help me with. Is the K1 Guide to Montreal here basically the same for 1R1/CR1 as well? Can our attorney file electronically the same way we can? Not MTL specific but...What is the income requirement? I am not the bread winner and assumed we would need my parents to co-sponsor but now I am thinking we might not need to do that based on some of the threads I have read but I am not 100% sure. Thanks in advance!

Oh and I could be posting this question in the wrong spot but generally how long after POE will my husband receive all of the documents required for him to work legally in the US? Again, THANK YOU!

Here's the Montreal EP guige for IR-1/CR-1, it's super helpful: http://www.visajourney.com/wiki/index.php/NVC_for_Montreal_Beneficiaries_%E2%80%93_Electronic_Processing_and_New_Online_Forms

As for the income requirements, you can find that here: http://www.uscis.gov/i-864p

We haven't done POE yet, but I'm pretty sure as soon as you enter the US you're legally allowed to work. It might be an issue with waiting for your SSN though, because I believe you need that in order for your company to be able to pay you and withhold your taxes. I'm not 100% sure though, I'm sure someone else can help.

As a cr-1//IR-1 1 can work right away! Once you go through the POE and get the I-551 stamp endorsed (som e say activated, lol) you are good to go, that acts as ur green card, until the actual card arrives. Of course some employers may not want to hire you until the SSN arrives. I know a few of posted on here they got a job before the SSN arrived--but they did not get paid until they had the SSN. And keep in mind--even though u checked the box to get the SSN--it may not arrive. They recommend you wait 10 business days and if no SSN--head down to ur local SSN office and make an inquiry-----highly recommend u download and fil out the form ahead of time (and bring the proper ID) so if they say no, ur not in the system, u can hand over the already filled form.. Does not concern u (hopefully, lol) but with the govt shut down---they are currently not issuing new SSN #'s!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

I've read that during the government shutdown you won't automatically receive your SSC, but if you show up in person to the local office they can get you one. Going through my NVC portion of my K1 right now, so I'm learning as I go too. Hopefully by the time I get down there the government is re-opened and we haven't fallen into the sea and all will be automatic again.

Your attorney can do the EP for sure, but I'm unsure about the DS-260. The benefits of having an attorney is that the DS-261 is moot and both your AOS and IV bills will be invoiced at the same time.

Study up on the DS-260 though. It requires exact addresses for everywhere you've lived since you were 16, for any length of time. Maybe you haven't moved much, but I had 18 moves, (13 different addresses.) /nightmares LOL

Will do, should I do the same for my husband?
