To whom it will concern,


I got married to US citizen in May 2013, my visa expired in August 2013, we applied the documents just now they are not ready yet. But my passport will expire in December,

can i leave the country without any trouble? and what documents i should present to the officer at the border, if my travel document will not be ready by December? how will i be ready to come back to US?

**** Moving from DCF to Travelling During US imigration ****

How did you get to the US in the first place? Ie K1, or work visa, or student visa etc?

Can you not renew your non-US passport with your country's embassy?

Did you apply for the EAD/ AP combo card?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Why do you need to leave the country? If you leave the U.S. during AOS without Advance Parole and without H or L status, you will abandon your AOS.

Yes I could renew my passport in US, but It takes 4 months, I have an emrgency at home.

I applied I-765, I-485, I-131 Forms.

So I understand that you have filed I-485 and I-131, etc., but they have no been approved yet?

There are two unrelated things you are asking about.

First, if you leave the U.S. without advance parole, your adjustment of status (i.e. green card application, I-485) will be abandoned. For that you need to make an infopass appointment at a USCIS office and ask for emergency Advance Parole, with proof of the emergency and I-131. Then, you are saying that your passport is close to expiring, and it takes a long time to get a new one. But since your passport is not expired, you can use it to go back to your country now, before it expires. Once you get back to your country, you can get a new one there (hopefully more conveniently).
